The case is the criminal prosecution of Maksim Zaslavskiy&#8217;s RECoin and Diamond Reserve Club, which sold tokens backed by real estate and diamonds &#8230; that turned out not to exist. Zaslavskiy moved to dismiss the case on the grounds that his tokens weren&#8217;t securities, so weren&#8217;t in the SEC&#8217;s jurisdiction, and that securities law was too vague to be applied to ICOs. Judge Raymond Dearie didn&#8217;t buy it \u2014 &#8220;Simply labeling an investment opportunity as a \u2018virtual currency\u2019 or \u2018cryptocurrency\u2019 does not transform an investment contract \u2014 a security \u2014 into a currency.&#8221; The question of whether RECoin and Diamond Reserve Club really were securities will be a matter for the jury \u2014 but the judge considers the SEC&#8217;s claim can go forward.<\/p>\n<p>The SEC also <a href=\"https:\/\/www.sec.gov\/news\/press-release\/2018-185\">settled charges<\/a> today against TokenLot, Lenny Kugel, and Eli L. Lewitt for acting as unregistered broker-dealers in the process of selling ICO tokens in their &#8220;ICO Superstore&#8221; \u2014 because ICOs are securities, so brokers have to register. TokenLot shut down in February 2018 after the SEC called, and gave everyone back their bitcoins and ether. TokenLot&#8217;s <a href=\"https:\/\/www.tokenlot.com\/goodbye.html\">goodbye page<\/a> (<a href=\"https:\/\/web.archive.org\/web\/20180911211052\/https:\/\/www.tokenlot.com\/goodbye.html\">archive<\/a>) talks about their &#8220;incredible journey&#8221; and blames &#8220;the ever changing regulatory landscape of the cryptocurrency space in our jurisdiction&#8221; \u2014 specifically, the bit of the regulatory landscape that fined them $569,000 and barred them from penny stocks and investment involvement for three years. Here&#8217;s <a href=\"https:\/\/www.sec.gov\/litigation\/admin\/2018\/33-10543.pdf\">the order.<\/a><\/p>\n<p>And the SEC temporarily halted US trading in <a href=\"https:\/\/uk.reuters.com\/article\/us-usa-cryptocurrency-sec\/sec-halts-trading-in-two-cryptocurrency-products-citing-market-confusion-idUKKCN1LP0TW\">two pretend-ETFs,<\/a> CXBTF and CETHF, for Bitcoin and Ethereum \u2014 they&#8217;re based in Sweden at <a href=\"https:\/\/en.wikipedia.org\/wiki\/Stockholm_Stock_Exchange\">Nasdaq Stockholm,<\/a> but were also traded over-the-counter in the US. <a href=\"https:\/\/www.sec.gov\/litigation\/suspensions\/2018\/34-84063.pdf\">Here&#8217;s the order.<\/a><\/p>\n<p>Remember when tiny biotech company Bioptix changed its name to Riot Blockchain, and got a sudden stock pump? The CEO, John O&#8217;Rourke, and major shareholder Barry Honig have been <a href=\"https:\/\/uk.reuters.com\/article\/us-riot-blockchain-moves\/riot-blockchain-names-new-leaders-as-previous-boss-faces-fraud-charges-idUKKCN1LQ04G\">charged by the SEC with penny-stock fraud.<\/a> So Riot&#8217;s COO is now the CEO. Drose: <a href=\"https:\/\/t.co\/IS4fFbGbrL\">https:\/\/t.co\/IS4fFbGbrL<\/a>)<\/p>\n<p>&mdash; Michael Goode, A.M., DuckLord\ud83e\udd86 (@goodetrades) <a href=\"https:\/\/twitter.com\/goodetrades\/status\/1038137175538364417?ref_src=twsrc%5Etfw\">September 7, 2018<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>&nbsp;<\/p>\n<p>The International Monetary Fund <a href=\"https:\/\/www.imf.org\/en\/Publications\/CR\/Issues\/2018\/09\/10\/Republic-of-the-Marshall-Islands-2018-Article-IV-Consultation-Press-Release-Staff-Report-and-46216\">warns the Marshall Islands<\/a> against releasing the SOV cryptocurrency they were <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2018\/03\/04\/news-kraken-loses-japanese-banking-marshall-islands-issues-crypto-quebec-vs-miners-uk-labour-vs-cryptos-failed-icos-bitcoin-usage-declines-btc-global\/\">planning in February<\/a> \u2014 and this is not the IMF strong-arming them, it&#8217;s the IMF pointing out to them that they have only one US dollar <a href=\"https:\/\/en.wikipedia.org\/wiki\/Correspondent_account\">correspondent bank<\/a> left, relations with that bank are shaky, and they will almost certainly lose that bank if they proceed with this terrible idea. The <a href=\"https:\/\/www.bbc.co.uk\/news\/technology-45485685\">BBC article<\/a> quotes me at length. The <a href=\"https:\/\/www.imf.org\/~\/media\/Files\/Publications\/CR\/2018\/cr18270.ashx\">IMF report<\/a> (PDF) is sensible and readable \u2014 Ctrl-F on &#8220;cryptocurrency&#8221; for the locally-relevant bits.<\/p>\n<p>Papua New Guinea, another small country desperate for cash, is looking toward approving a <a href=\"http:\/\/pngicentral.org\/reports\/govt-to-cede-sovereignty-in-cryptocurrency-gamble\">Special Economic Zone for cryptocurrencies,<\/a> to be run by Ledger Atlas. This was <a href=\"https:\/\/www.ethnews.com\/us-blockchain-startup-to-operate-special-economic-zone-in-papua-new-guinea\">first floated in May.<\/a> Ledger have basically bought themselves a semi-sovereign chunk of a country, to run as a libertarian paradise\u00a0\u2014 &#8220;<span data-reactid=\"160\">The preamble to the proposed legislation states explicitly the SEZ will restrict citizens constitutional rights to freedom from arbitrary search and entry; freedom or conscience, thought and religion; freedom of expression and publication; freedom of assembly and association; freedom of choice of employment; reasonable privacy; vote and stand for public office; reasonable access to official documentation; freedom of movement; and protection from unjust deprivation of property.<\/span>&#8221; Because the market will take care of all that \u2014 on the blockchain!<\/p>\n<p>Two new &#8220;stablecoins&#8221; are <a href=\"https:\/\/www.reuters.com\/article\/us-cryptocurrency-dollar-paxos-winklevos\/new-york-regulator-approves-winklevoss-paxos-dollar-linked-tokens-idUSKCN1LQ1O5\">approved by New York<\/a> \u2014 the <a href=\"https:\/\/medium.com\/gemini\/gemini-launches-the-gemini-dollar-62787f963fb4\">Gemini Dollar<\/a> (an ERC-20 token) and the <a href=\"https:\/\/standard.paxos.com\/whitepaper.pdf\">Paxos Standard.<\/a> The idea is money that flows at the speed of the Ethereum blockchain &#8230; but is properly regulated. (Gemini&#8217;s entire pitch is that it&#8217;s trustworthy and compliant.) Nobody is quite clear how either of these will work this way in practice, given the whole point of tokens is to flow freely \u2014 which was the problem with the Marshall Islands proposal. Both are backed by actual dollar deposits.<\/p>\n<p>An actual economist, Professor Barry Eichengreen from UCB, writes on <a href=\"https:\/\/www.theguardian.com\/technology\/2018\/sep\/11\/stable-coins-bitcoin-cryptocurrencies-tether\">why &#8220;stablecoins&#8221; aren&#8217;t an answer<\/a> to Bitcoin&#8217;s instability.<\/p>\n<p>CNN:<a href=\"https:\/\/money.cnn.com\/2018\/09\/11\/investing\/bitcoin-crash-victim\/index.html\"> Bitcoin crash: This man lost his savings when cryptocurrencies plunged<\/a>\u00a0\u2014 Sean Russell, from Leeds in the UK, lost everything in the crash: &#8220;the paper losses on his initial investment have reached 96%.&#8221; He&#8217;s still hodling \u2014 &#8220;I have to be hopeful about something,&#8221; he said. &#8220;I need to keep my mind occupied, because when I just focused on the money I lost, it destroyed me mentally and emotionally.&#8221; And, you know what Mr Russell does by day? He&#8217;s a <a href=\"https:\/\/www.crypto-consultant.co.uk\/\">crypto consultant<\/a> (<a href=\"https:\/\/archive.is\/jbPy7\">archive<\/a>) \u2014 advising others how to take on his bagholding. &#8220;Could 1 Bitcoin be worth \u00a31 Million by 2020? Unfortunately, he has an even vaguer idea of what a blockchain or DLT is, but he&#8217;s sure these will afflict banks with the punishment they deserve, by unspecified means. <a href=\"https:\/\/www.icoexaminer.com\/ico-news\/australian-prime-minister-blockchain-is-going-to-transform-australian-banking-system\/\">ICO Examiner<\/a> found the <a href=\"https:\/\/www.youtube.com\/watch?v=XEVkD7nnnVM\">video,<\/a> where Morrison was asked about this by Tim Meyer of <a href=\"http:\/\/cryptolabs.com.au\/\">CryptoLabs,<\/a> who sell mining rigs.<\/p>\n<p>The Reserve Bank of India <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2018\/04\/28\/news-iota-cultists-ethereum-as-security-exchange-regulation-and-market-manipulation-wikipedia\/\">directed lenders in April<\/a> to wind down all business dealings with cryptocurrency exchanges within three months. The exchanges took the RBI to court \u2014 and the Supreme Court <a href=\"https:\/\/qz.com\/india\/1385551\/rbi-bitcoin-exchanges-case-in-final-stage-in-indian-supreme-court\/\">begins final hearings<\/a> tomorrow, 12 September.<\/p>\n<p>R3 and Ripple Labs have <a href=\"https:\/\/www.coindesk.com\/r3-ripple-settle-legal-dispute-over-xrp-purchase-option\/\">finally settled<\/a> their <a href=\"https:\/\/www.reuters.com\/article\/r3-ripple-lawsuit\/blockchain-startup-r3-sues-competitor-ripple-idUSL2N1LP181\">long-running legal dispute<\/a> over R3&#8217;s option to purchase a pile of XRP cheap. Terms were not disclosed.<\/p>\n<p>How viable is the exciting world of bitcoin mining these days? <a href=\"https:\/\/bitfarms.io\/\">Bitfarms<\/a> in Canada provide us with a handy worked example, in the form of their <a href=\"https:\/\/www.bitfarms.io\/docs\/half-year-2018\/bitfarms_h1_final.pdf\">Half-Year 2018 Consolidated Financial Results,<\/a> released 30 August. Various people try to gently explain what a hashing function is, and that you won&#8217;t get rich pointing an AI at Bitcoin mining.<\/p>\n<p>Jack Dorsey of Twitter to Congress: <a href=\"https:\/\/www.coindesk.com\/dorsey-tells-congress-twitter-is-thinking-about-blockchain-solutions\/\">perhaps blockchain will fix my social network.<\/a><\/p>\n<p>Joe Lubin and Amanda Gutterman of Consensys put forward an <a href=\"https:\/\/twitter.com\/TechCrunch\/status\/1037832006271287296\">incomprehensible pitch<\/a> for Civil, a <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2018\/03\/04\/ico-tokens-wont-fix-journalism-either-and-certainly-not-with-company-scrip\/\">journalism on the blockchain<\/a> ICO. If you use the Ethereum blockchain, you can use a token (that totally isn&#8217;t a security) to vote which facts are true and which journalists are <a href=\"https:\/\/rationalwiki.org\/wiki\/List_of_Gamergate_claims\">ethical!<\/a> I can&#8217;t see any possible problems with this, can you? He was <a href=\"https:\/\/twitter.com\/cryptovenus\/status\/1039516064529305603\">released<\/a> after 24 hours. Cryptovenus <a href=\"https:\/\/twitter.com\/cryptovenus\/status\/1039541962796421120\">tweets:<\/a> &#8220;The real story behind this OKEx ordeal is the fact Star himself asked the police to come rescue him! This was because he was surrounded by users whom had lost money in Cryptos on OKEx.&#8221;<\/p>\n<p>How <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2018-09-11\/crypto-exchanges-embrace-controversial-practices-as-demand-eases\">crypto exchange marketing<\/a> works, as trading slows right down\u00a0\u2014 charge to list minor altcoins, but offer discounts if the coin can steer depositors onto the exchanges.<\/p>\n<p>And the first half of <a href=\"https:\/\/www.ccn.com\/op-ed-the-real-story-how-cryptocurrency-exchanges-extract-profit-from-everyone\/amp\/\">this post<\/a> is an excellent writeup of how corrupt the crypto trading markets are. So, Microsoft Azure Blockchain gives us: <a href=\"https:\/\/azure.microsoft.com\/en-us\/blog\/introducing-enterprise-smart-contracts\/\">Enterprise Smart Contracts!<\/a> These execute &#8220;off-chain&#8221;. That is, they&#8217;re a separate program to manipulate your blockchain. Just like when you&#8217;re writing programs to manage real databases.<\/p>\n<p>Remember how cryptocurrency TRON bought the meaningless shell of BitTorrent, Inc., after Bram Cohen had long given up and was working on <a href=\"https:\/\/chia.net\/\">ChiaNet<\/a>? It seems a pile of other cryptos were <a href=\"https:\/\/www.coindesk.com\/bittorrent-courted-eos-filecoin-cryptocurrency-creators-prior-to-tron-sale\/\">eyeing it up.<\/a> Something to do with the ICO money, I suppose.
