{"id":8821,"date":"2018-07-30T17:48:55","date_gmt":"2018-07-30T17:48:55","guid":{"rendered":"https:\/\/davidgerard.co.uk\/blockchain\/?p=8821"},"modified":"2018-07-31T13:41:17","modified_gmt":"2018-07-31T13:41:17","slug":"augurs-big-problem-is-not-the-assassination-markets-its-being-a-bucket-shop","status":"publish","type":"post","link":"https:\/\/davidgerard.co.uk\/blockchain\/2018\/07\/30\/augurs-big-problem-is-not-the-assassination-markets-its-being-a-bucket-shop\/","title":{"rendered":"Augur&#8217;s big problem is not the assassination markets \u2014 it&#8217;s being a bucket shop"},"content":{"rendered":"<p>After years in the making \u2014 the <a href=\"http:\/\/www.foxnews.com\/tech\/2015\/08\/20\/new-tech-promises-government-proof-prediction-markets.html\">ICO was in 2015<\/a> \u2014 the <a href=\"https:\/\/www.augur.net\/\">Augur prediction market<\/a> is open for business!<\/p>\n<p>And the first thing crypto libertarians did was put up &#8220;predictions&#8221; that are functionally an <a href=\"https:\/\/mashable.com\/2018\/07\/24\/augur-ethereum-blockchain-assassination-market\/?europe=true\">assassination market &mdash; but on the blockchain.<\/a><\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2018\/07\/30\/augurs-big-problem-is-not-the-assassination-markets-its-being-a-bucket-shop\/augur-assassination-market-donald-trump\/\" rel=\"attachment wp-att-8824\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-8824\" src=\"https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2018\/07\/augur-assassination-market-donald-trump.jpg\" alt=\"\" width=\"600\" height=\"164\" srcset=\"https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2018\/07\/augur-assassination-market-donald-trump.jpg 1022w, https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2018\/07\/augur-assassination-market-donald-trump-300x82.jpg 300w, https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2018\/07\/augur-assassination-market-donald-trump-768x210.jpg 768w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>The mechanism is: I bet you a large pile of cryptos that X <i>won&#8217;t<\/i> die by Y time. Oh look, X died by Y time \u2014 here&#8217;s your large pile of cryptos!<\/p>\n<p>I predict that these won&#8217;t be Augur&#8217;s big problem! Holders of Augur&#8217;s REP token decide how a bet was resolved \u2014 &#8220;yes,&#8221; &#8220;no,&#8221; &#8220;indeterminate&#8221; or &#8220;unethical.&#8221; They <i>probably<\/i> won&#8217;t be foolish enough to let assassination bets through. Probably.<\/p>\n<p>Instead, I think Augur&#8217;s problem will be that <a href=\"https:\/\/en.wikipedia.org\/wiki\/Prediction_market\">&#8220;prediction markets&#8221;<\/a> are what we used to call <a href=\"https:\/\/en.wikipedia.org\/wiki\/Bucket_shop_(stock_market)\">&#8220;bucket shops&#8221;<\/a>\u00a0\u2014 for gambling on security and commodity prices. And the regulators really aren&#8217;t fond of these.<\/p>\n<h3>Prediction markets and the oracle problem<\/h3>\n<p><a href=\"https:\/\/davidgerard.co.uk\/blockchain\/table-of-contents\/\">Chapter 10<\/a> of <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/book\/\"><em>Attack of the 50 Foot Blockchain<\/em><\/a> goes into the &#8220;oracle problem&#8221; at length.<\/p>\n<p>In software testing, an <a href=\"https:\/\/en.wikipedia.org\/wiki\/Test_oracle\">&#8220;oracle&#8221;<\/a> is any mechanism that determines if a test has passed or failed. The &#8220;oracle problem&#8221; is how to do this in a completely automated way\u00a0\u2014 without costly human intervention.<\/p>\n<p>This also applies to smart contracts that want to interact with the real world \u2014 how do you tell if your real-world condition has been met?<\/p>\n<p>And remember\u00a0\u2014 garbage in means garbage out. Per <a href=\"https:\/\/www.bloomberg.com\/view\/articles\/2017-07-05\/crossing-the-rubicon-and-gagging-shkreli\">Matt Levine on Bloomberg:<\/a> \u201cMy immutable unforgeable cryptographically secure blockchain record proving that I have 10,000 pounds of aluminum in a warehouse is not much use to a bank if I then smuggle the aluminum out of the warehouse through the back door.\u201d<\/p>\n<p>For questions with a subjective element \u2014 was the President murdered, or did he die of natural causes? \u2014 humans have to decide whether the event has occurred.<\/p>\n<p>A common proposal is to outsource your oracle to a prediction market that is also on your blockchain\u00a0\u2014 such as Augur.<\/p>\n<p>There are <a href=\"https:\/\/ethereum.stackexchange.com\/questions\/2\/how-can-an-ethereum-contract-get-data-from-a-website\">third-party services<\/a> such as oraclize.it, which act as an interface between public websites \u2014 such as stock tickers \u2014 and the Ethereum blockchain.<\/p>\n<p>This isn&#8217;t a panacea. If your question isn\u2019t popular enough to attract sufficient uninvolved wagers, then it will often be worth it for one party to just bribe the bettors. You can\u2019t get rid of the human element by adding another layer of indirection \u2014 it\u2019s oracles all the way down.<\/p>\n<p>And in the case of a bet that a particular person <i>won&#8217;t<\/i> die &#8230; well, there&#8217;s an obvious way to win the other side of that bet.<\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2018\/07\/30\/augurs-big-problem-is-not-the-assassination-markets-its-being-a-bucket-shop\/augur-logo\/\" rel=\"attachment wp-att-8839\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-8839\" src=\"https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2018\/07\/augur-logo.png\" alt=\"\" width=\"400\" height=\"160\" srcset=\"https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2018\/07\/augur-logo.png 600w, https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2018\/07\/augur-logo-300x120.png 300w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<h3>Augur sets its DAO free!<\/h3>\n<p>Pure smart contracts have no human intervention possible \u2014 they&#8217;re just a program running on its own, forever. This relies on being able to write a computer program that&#8217;s perfect, bug-free and never needs updating ever again once deployed &#8230; which is a set of conditions that holds approximately 0% of the time.<\/p>\n<p>The usual method \u2014 which is recommended in the <a href=\"https:\/\/github.com\/ethereum\/wiki\/wiki\/White-Paper#decentralized-autonomous-organizations\">Ethereum white paper<\/a> \u2014 is to make a variable in your smart contract that points to a separate program that does the real work. If you want to update your program, change the pointer to refer to the new code.<\/p>\n<p>Of course, this means your &#8220;smart contract&#8221; is not immutable, and is functionally just another completely centralised computer program. Not that this ever stopped an ICO promoter from saying &#8220;decentralised!&#8221;<\/p>\n<p>Augur, however, are purists. Also, they wanted <a href=\"http:\/\/www.foxnews.com\/tech\/2015\/08\/20\/new-tech-promises-government-proof-prediction-markets.html\">deniability.<\/a> So &#8230; they removed their ability to change their own contract!<\/p>\n<p>&nbsp;<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Happy two weeks! \ud83c\udf89 Ownership of the escape hatch has been transferred to the 0x000..0001 address.<\/p>\n<p>&mdash; Augur (@AugurProject) <a href=\"https:\/\/twitter.com\/AugurProject\/status\/1021631296265768960?ref_src=twsrc%5Etfw\">July 24, 2018<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>&nbsp;<\/p>\n<p>They didn&#8217;t do this until <a href=\"https:\/\/www.ccn.com\/first-assassination-markets-appear-on-gambling-platform-augur\/\"><i>after<\/i><\/a> the first assassination market bets had shown up. But presumably they are doing this to claim they&#8217;re not responsible for abuse of the platform. The Forecast Foundation <a href=\"https:\/\/www.augur.net\/faq\/\">disclaims all liability<\/a> for untoward use of Augur.<\/p>\n<p>In practice, the question of the Forecast Foundation&#8217;s culpability for assassination markets \u2014 and the culpability of any traceable REP holder who didn&#8217;t vote &#8220;unethical&#8221; on such a bet \u2014 will start with long and uncomfortable discussions with the Secret Service.<\/p>\n<p>And their free-floating DAO is now a sitting-duck fixed target for attackers like those that took out <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/the-dao\/\">the most famous DAO.<\/a><\/p>\n<h3>The bucket shop problem<\/h3>\n<p>However \u2014 Augur will be used to make bets on securities and commodities prices. This is called a <a href=\"https:\/\/en.wikipedia.org\/wiki\/Bucket_shop_(stock_market)\">bucket shop,<\/a> and &#8230; it&#8217;s illegal!<\/p>\n<p>The US Supreme Court defined a bucket shop in 1906 as:<\/p>\n<blockquote><p>An establishment, nominally for the transaction of a stock exchange business, or business of similar character, but really for the registration of bets, or wagers, usually for small amounts, on the rise or fall of the prices of stocks, grain, oil, etc., there being no transfer or delivery of the stock or commodities nominally dealt in.<\/p><\/blockquote>\n<p>This is not hypothetical \u2014 in early July 2018, the CFTC got a <a href=\"https:\/\/www.cftc.gov\/PressRoom\/PressReleases\/7758-18\">$3 million judgement against InTrade,<\/a> an Irish prediction market company, for trading binary options \u2014 bets on commodity prices \u2014 in violation of a 2005 cease and desist order.<\/p>\n<p>And the CFTC is <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2018-07-26\/as-crypto-meets-prediction-markets-u-s-regulators-take-notice\">quite aware of Augur:<\/a><\/p>\n<blockquote><p>&#8220;While I won\u2019t comment on the business model of any specific company, I can say generally that offering or facilitating a product or activity by way of releasing code onto a blockchain does not absolve any entity or individual from complying with pertinent laws or CFTC regulations,&#8221; Erica Elliott Richardson, a CFTC spokeswoman, said in an emailed reply to questions.<\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2018\/07\/30\/augurs-big-problem-is-not-the-assassination-markets-its-being-a-bucket-shop\/sand-hill-exchange-screen-shot\/\" rel=\"attachment wp-att-8841\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-8841\" src=\"https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2018\/07\/sand-hill-exchange-screen-shot.png\" alt=\"\" width=\"600\" height=\"273\" srcset=\"https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2018\/07\/sand-hill-exchange-screen-shot.png 972w, https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2018\/07\/sand-hill-exchange-screen-shot-300x137.png 300w, https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2018\/07\/sand-hill-exchange-screen-shot-768x350.png 768w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<h3>Sand Hill Exchange<\/h3>\n<p>Crypto-based bucket shops have been penalised previously. You&#8217;ll know Elaine Ou as a blockchain luminary and occasional <a href=\"https:\/\/www.bloomberg.com\/view\/contributors\/AS-u1cDvxx8\/elaine-ou\">Bloomberg columnist,<\/a> but she came to fame a few years ago running Sand Hill Exchange \u2014 a bucket shop where you could bet on the eventual market prices of startups. Not only that \u2014 they faked trades and prices, to create the illusion of market activity.<\/p>\n<p>Sand Hill started in late 2014 as a fantasy trading site. Around February 2015, they started taking real money, including bitcoins. They shut down by <a href=\"https:\/\/www.bloomberg.com\/view\/articles\/2015-04-20\/can-kicking-and-activism\">April 2015<\/a> \u2014 approximately <a href=\"https:\/\/www.bloomberg.com\/view\/articles\/2015-06-19\/bitcoin-bucket-shop-kicks-bucket\">&#8220;as soon as anyone noticed it existed.&#8221;<\/a><\/p>\n<p>The SEC brought an <a href=\"https:\/\/www.sec.gov\/litigation\/admin\/2015\/33-9809.pdf\">administrative order<\/a> on 17 June 2015 against Ou and her business partner Gerrit Hall, which details the full history of Sand Hill:<\/p>\n<blockquote><p>Hall and Ou sought people to fund accounts at Sand Hill using dollars or bitcoins. They had a public web site, but primarily had success recruiting their friends and acquaintances. Investors bought and sold contracts linked to liquidity events and to the value of the companies and their securities.<\/p>\n<p>For about seven weeks, Sand Hill, Hall and Ou offered, bought and sold contracts through the web site in violation of the Dodd-Frank provisions that limit transactions in security-based swaps with persons who are not eligible contract participants. During that time, Hall and Ou exaggerated Sand Hill\u2019s trading, operations, controls, and financial backing. Sand Hill, Hall and Ou ceased offering and selling security-based swaps in the face of inquiries from the Commission staff on or about April 8, 2015.<\/p><\/blockquote>\n<p>There&#8217;s a fine line between <a href=\"https:\/\/ftalphaville.ft.com\/2015\/06\/02\/2130891\/maybe-sand-hill-is-not-the-new-wall-st-after-all\/\">&#8220;startup growth hacks&#8221;<\/a> and flagrant illegality. They were fined $20,000.<\/p>\n<p>(That SEC administrative order is short and very readable, and you should definitely give it a read through.)<\/p>\n<p>Sand Hill Exchange was a centralised enterprise. But the same considerations apply, as long as there are touchable humans involved \u2014 and you&#8217;re always going to have to interact with society at some point.<\/p>\n<p>The Forecast Foundation&#8217;s principals will almost certainly have to deal with the SEC and CFTC on Augur-based bucket shops, as long as they&#8217;re involved in the Augur platform in any manner whatsoever \u2014 including making money from the REP tokens used on it. There is literally no fancy corporate shell game that the SEC and CFTC aren&#8217;t deeply familiar with, and know how to address in a conclusive manner.<\/p>\n<p>&nbsp;<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">So meta &#8211; &quot;Still, a contract listed on the site may be worth watching. It asks, &quot;Will the Forecast Foundation face an enforcement action from the SEC or CFTC before Dec. 21, 2018 for hosting unregulated derivatives markets?&quot;&quot;\ud83d\udc40 <a href=\"https:\/\/t.co\/WJP0C6kefs\">https:\/\/t.co\/WJP0C6kefs<\/a><\/p>\n<p>&mdash; Conor O&#39;Hanlon (@Conor0Hanlon) <a href=\"https:\/\/twitter.com\/Conor0Hanlon\/status\/1022530449460146181?ref_src=twsrc%5Etfw\">July 26, 2018<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>&nbsp;<\/p>\n<h3>But what if someone forks Augur?<\/h3>\n<p>Augur is open-source code, so it&#8217;s quite likely that someone else will set up free-floating bucket shops, or even assassination markets. Because this is crypto, and there&#8217;s no concept in crypto that&#8217;s so obviously terrible that someone won&#8217;t think &#8220;what a brilliant idea!&#8221;<\/p>\n<p>And test just how traceable cryptos are when you attract a government&#8217;s <em>serious<\/em> interest.
