What if something happened to Tether, Inc?<\/p>\n<p><a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2018\/03\/17\/send-in-the-tether-clones-trueusd-a-usd-backed-stable-cryptocurrency\/trueusd\/\" rel=\"attachment wp-att-5480\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-5480\" src=\"https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2018\/03\/trueusd-300x86.png\" alt=\"\" width=\"300\" height=\"86\" srcset=\"https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2018\/03\/trueusd-300x86.png 300w, https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2018\/03\/trueusd.png 461w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a>Well, anyone can do a token. We&#8217;ve had the <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2017\/11\/20\/there-can-only-ever-be-21-million-forks-of-bitcoin-a-survey-so-far\/\">army of Bitcoin clones<\/a> \u2014 now we have the first of the Tether clones: <a href=\"https:\/\/www.trueusd.com\/\">TrueUSD,<\/a> which <a href=\"https:\/\/twitter.com\/TrustToken\/status\/970837514125656064\">went live<\/a> on the Bittrex exchange on 6 March:<\/p>\n<blockquote><p>We\u2019re excited to <a href=\"https:\/\/blog.trusttoken.com\/trueusd-a-usd-backed-stablecoin-you-can-trust-9688796cfd0d\">announce<\/a> the launch of TrueUSD, a USD-backed stable cryptocurrency. TrueUSD offers token-holders full collateral, regular auditing, and legal protections to redeem TrueUSD for USD.<\/p><\/blockquote>\n<h3>Use cases of dollar-substitute tokens<\/h3>\n<p>The main use cases for dollar-substitute tokens are variants on &#8220;I can&#8217;t move lots of dollars around the crypto markets as fast as I&#8217;d like to.&#8221;<\/p>\n<p>Arbitrage between exchanges is <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2017\/12\/17\/why-you-cant-cash-out-pt-1-why-bitcoins-price-is-largely-fictional\/\">difficult and long-winded,<\/a> because the market is badly structured\u00a0\u2014 so it&#8217;s slow and hard to move either cryptos or actual money between exchanges.<\/p>\n<p>In the crypto markets, actual US dollars aren&#8217;t very liquid \u2014 to move them from one exchange to another, you have to do a withdrawal then a deposit, and you hit <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2017\/12\/23\/why-you-cant-cash-out-pt-2-bitcoin-and-know-your-customer-anti-money-laundering-laws-kyc-aml\/\">Know Your Customer<\/a> regulations, designed to combat money laundering. But a token can flow at the speed of crypto.<\/p>\n<p>You can arbitrage via a minor cryptocurrency \u2014 an altcoin \u2014 but they tend to be very volatile and very illiquid. Just trying to move them in quantity will do bad things to the price.<\/p>\n<p>There have been attempts at algorithmic &#8220;stablecoins&#8221; whose price is maintained by clever algorithms. These are <a href=\"https:\/\/prestonbyrne.com\/2017\/12\/10\/stablecoins-are-doomed-to-fail\/\">not stable against general market declines<\/a> \u2014 and crypto prices go up and down like a yoyo.<\/p>\n<h3>Tether<\/h3>\n<p>Enter Tether, which claims to be backed by the US dollar \u2014 one USD on deposit for each USDT.<\/p>\n<p>There have been a number of problems verifying Tether&#8217;s claims, which I&#8217;ve <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/tag\/tether\/\">gone into previously<\/a>\u00a0\u2014 tethers <a href=\"http:\/\/www.tetherreport.com\/\">seem to be<\/a> released with timing such as to pump the price of Bitcoin, people <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2017\/12\/05\/bitfinex-rattles-legal-sabres-at-critics-tether-fails-to-redeem-usdt-1m-for-dollars\/\">can&#8217;t redeem<\/a> tethers for dollars, Tether <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2018\/01\/24\/news-friedman-llp-parts-with-bitfinex-weiss-crypto-ratings-netherlands-sec-icos-venezuela-arsenal\/\">failed<\/a> to achieve an audit\u00a0\u2014 but that&#8217;s the concept.<\/p>\n<p>And so far the market is still treating these as worth one dollar, and they circulate where actual US dollars don&#8217;t go \u2014 <em>e.g.<\/em>, exchanges that can&#8217;t get US dollar banking.<\/p>\n<p>So, at present, tethers <a href=\"https:\/\/weisscryptocurrencyratings.com\/alert\/the-danger-of-tether-218\">provide most<\/a> of the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Market_liquidity\">market liquidity<\/a> in the cryptocurrency trading system. This is <a href=\"http:\/\/www.news.com.au\/finance\/money\/investing\/without-this-scam-bitcoin-price-would-collapse-fears-grow-over-tether-printing-press-as-auditors-part-ways\/news-story\/308503ab61f82d320e92847a0b59a23b\">widely perceived<\/a> as a systemic risk, so obviously people are going to try to come up with workarounds. And so we come to TrueUSD.<\/p>\n<h3>TrueUSD<\/h3>\n<p>TrueUSD is an <a href=\"https:\/\/etherscan.io\/token\/0x8dd5fbce2f6a956c3022ba3663759011dd51e73e#balances\">ERC-20 token<\/a> on the public Ethereum blockchain. It&#8217;s being done by <a href=\"https:\/\/www.trusttoken.com\/\">TrustToken.<\/a><\/p>\n<p>TrueUSD appears to be an attempt to do a dollar-substitute token properly\u00a0\u2014 and <a href=\"https:\/\/blog.trusttoken.com\/trueusd-faq-18dbc563fb67\">address<\/a> the crypto market&#8217;s concerns about Tether.<\/p>\n<p>Their one weird legal trick is that they never touch the dollars themselves \u2014 the money goes to escrow accounts.<\/p>\n<blockquote>\n<p id=\"c8b9\" class=\"graf graf--p graf-after--h4\">TrueUSD is a USD-backed ERC20 stablecoin that is fully collateralized, legally protected, and transparently audited. TrueUSD uses multiple escrow accounts to reduce <span class=\"markup--quote markup--p-quote is-other\" data-creator-ids=\"cc962472a1e5\">counterparty<\/span> risk, and to provide token-holders with legal rights to the funds. TrueUSD is the first major built on the TrustToken platform.<\/p>\n<p id=\"d764\" class=\"graf graf--p graf-after--h4\"><a class=\"markup--anchor markup--p-anchor\" href=\"http:\/\/www.trusttoken.com\" target=\"_blank\" rel=\"noopener noreferrer\" data-href=\"http:\/\/www.trusttoken.com\">TrustToken<\/a> is a set of legal and technical standards to tokenize real-world currencies and assets.<\/p>\n<\/blockquote>\n<p>Their target market is the user base for tethers:<\/p>\n<blockquote>\n<p id=\"65c8\" class=\"graf graf--p graf-after--h4\">We\u2019ve designed the alpha version to address the immediate needs of crypto exchanges, crypto traders, and financial companies.<\/p>\n<\/blockquote>\n<p>The <a href=\"https:\/\/docs.google.com\/document\/d\/1dQ0jqzkwZr0lYbxu18IXxZgKEXEn7QTwtlSrbTBv1lU\/edit\">press release<\/a> goes further \u2014 it posits TrueUSD as being usable as actual money too:<\/p>\n<blockquote><p><b>Mainstream commerce<\/b> &#8211; Anyone can enjoy the benefits of digital currencies (faster transaction speed than ACH, global reach) without the volatility of Bitcoin. Now you can pay a salary, take out a loan, or buy coffee with a cryptocurrency, enabling a new economy of cryptocurrency financial applications.<\/p><\/blockquote>\n<h3>Problems with TrueUSD<\/h3>\n<p>So, you buy some TUSD. Can you redeem them? Well, only if you&#8217;re <a href=\"https:\/\/twitter.com\/Diacritic\/status\/970844990736920581\">one of the big fish<\/a> for now. (Check the <a href=\"https:\/\/blog.trusttoken.com\/how-to-purchase-and-redeem-trueusd-a-guide-for-traders-ad8b141a9039\">how-to for traders<\/a>.)<\/p>\n<p>There isn&#8217;t even a USD trading pair \u2014 Bittrex only <a href=\"https:\/\/bittrex.com\/Market\/Index?MarketName=BTC-TUSD\">trade it against Bitcoin,<\/a> where it varies between $0.91 and $1.01. It&#8217;s also on the <a href=\"https:\/\/coinmarketcap.com\/currencies\/true-usd\/#markets\">Upbit<\/a> exchange.<\/p>\n<p>No entity named as involved with TrueUSD can be found on a <a href=\"https:\/\/twitter.com\/Bitfinexed\/status\/970842898659979264\">FinCEN money services business registration search<\/a> \u2014 nor on the complete spreadsheet of MSBs downloadable from that page.<\/p>\n<p>TrustToken think they&#8217;ve <a href=\"https:\/\/blog.trusttoken.com\/money-services-business-msb-registration-for-trueusd-b0a5fc1ee673\">worked around<\/a> the requirement to list as an MSB, because they don&#8217;t touch the escrowed funds \u2014 and in case this isn&#8217;t sufficient, they <a href=\"https:\/\/twitter.com\/TrustToken\/status\/971884332657786885\">note<\/a> that they have <a href=\"https:\/\/www.fincen.gov\/money-services-business-msb-registration\">180 days to file<\/a> said paperwork.<\/p>\n<p>An audit has yet to be released, but TrustToken are proudly posting about their <a href=\"https:\/\/blog.trusttoken.com\/first-independent-attestation-of-trueusd-funds-published-by-cohen-company-b4be8ec733fb\">first<\/a>, <a href=\"https:\/\/blog.trusttoken.com\/second-independent-attestation-of-trueusd-funds-published-by-cohen-company-8a84c1433c13\">second<\/a> and <a href=\"https:\/\/blog.trusttoken.com\/third-independent-attestation-of-trueusd-funds-published-by-cohen-company-61a6540419dc\">third<\/a> Independent Attestations, which seem to be statements that funds were in an account as of a date. It&#8217;s not quite an audit, though it&#8217;s not as obviously deficient as <a href=\"https:\/\/ftalphaville.ft.com\/2017\/10\/02\/2194319\/tethers-transparency-update-is-out\/\">Tether&#8217;s non-audit &#8220;transparency update&#8221;<\/a> of September 2017.<\/p>\n<p>Unlike Tether, yesterday TrustToken finally <a href=\"https:\/\/blog.trusttoken.com\/who-are-the-correspondent-banks-and-trustee-partners-for-trueusd-e12508f0d5a2\">named some of the banks<\/a> they deal with.<\/p>\n<p>The people behind TrustToken and TrueUSD aren&#8217;t finance people at all, but cryptocurrency people \u2014 and their background is in weird transhumanist boondoggles, at their previous company, <a href=\"https:\/\/kernel.co\/\">Kernel.<\/a><\/p>\n<h3>Regulatory concerns<\/h3>\n<p>There&#8217;s nontrivial concern that all of this is a return to the era of <a href=\"https:\/\/en.wikipedia.org\/wiki\/Wildcat_banking\">wildcat banking<\/a> \u2014 and that <em>any<\/em> such &#8220;US dollar&#8221; token that allows free international trade is problematic.<\/p>\n<p>Some commenters have compared cryptocurrency substitute dollar tokens to <a href=\"https:\/\/en.wikipedia.org\/wiki\/Liberty_Reserve\">Liberty Reserve<\/a> \u2014 who offered a digital dollar-substitute currency, though centrally administered. Liberty Reserve was shut down by the US government in 2013 and the owner, Arthur Budovsky, was jailed for twenty years for money laundering.<\/p>\n<p>I don&#8217;t think they&#8217;re closely comparable \u2014 Budovsky was convicted of running a similar US-based operation, <a href=\"https:\/\/en.wikipedia.org\/wiki\/Gold_Age\">Gold Age,<\/a> and skipped his probation, went to Costa Rica and set up Liberty Reserve to do the same things again. I think a new operation would have to be similarly egregious to attract that level of US government ire.<\/p>\n<p>However, the primary use case for all such tokens is evading regulation. Enforcing KYC just at the point of first sale isn&#8217;t sufficient \u2014 FinCEN tend to get very concerned with anything that flows around as a substitute for money, <em>e.g.<\/em>, <a href=\"https:\/\/www.fincen.gov\/resources\/statutes-regulations\/guidance\/final-rule-definitions-and-other-regulations-relating\">phone cards.<\/a> TrueUSD&#8217;s aspiration to become a general-use private currency is definitely going to get their attention.<\/p>\n<p>It&#8217;s <em>possible<\/em> that KYC\/AML regulations are just hopelessly outmoded for the modern world and a workaround will prove so necessary and beneficial as to demonstrate this to the regulators &#8230; but I wouldn&#8217;t bet that way.<\/p>\n<p>Nevertheless, TrustToken seem to be doing their best to make all of this work legally.
