[<a href=\"https:\/\/restructuring.ra.kroll.com\/genesis\/Home-DownloadPDF?id1=MzA2NzEzNA==&amp;id2=-1\"><i>Doc 1314<\/i><\/a><i>; PDF<\/i>]<\/p>\n<p>Now is a good time for Genesis to sell. <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2024\/01\/10\/sec-approves-bitcoin-spot-etfs-what-this-means-for-crypto\/\">GBTC converted to an ETF<\/a> earlier this year, so the shares are close to the face value of the bitcoins they represent. Before the ETFs, GBTC was selling <a href=\"https:\/\/amycastor.com\/2022\/04\/19\/welcome-to-grayscales-hotel-california\/\">way below net asset value<\/a>.<\/p>\n<p>The outflow from GBTC will result in a sell-off of bitcoins. Those bitcoins are going to be sold even if it is out the back door via Coinbase custody. And they will be sold for actual dollars \u2014 not tethers. The market is sure to take a hit. We fully expect Tether to <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2023\/12\/06\/bitcoin-goes-up-can-5-billion-unbacked-tethers-kickstart-a-fresh-crypto-bubble\/\">issue more tethers<\/a> to fill the hole.<\/p>\n<p>DCG objects to the sale \u2014 that is, to the actions of its own subsidiary! DCG argued to Judge Sean Lane that the \u201csheer quantity of the Trust Assets at issue will pose a serious risk of value destruction.\u201d LOL. [<a href=\"https:\/\/restructuring.ra.kroll.com\/genesis\/Home-DownloadPDF?id1=MzA1OTcxNQ==&amp;id2=-1\"><i>Doc 1285<\/i><\/a><i>, PDF<\/i>]<\/p>\n<p>DCG told Judge Lane that if Genesis wants to sell GBTC, DCG should have the right to be consulted. DCG is probably \u201cthe most knowledgeable party with respect to these assets\u201d because DCG created GBTC. Judge Lane pointed out the very obvious \u201cinherent conflict.\u201d [<a href=\"https:\/\/www.wsj.com\/articles\/genesis-cleared-to-sell-grayscale-shares-valued-at-1-6-billion-7a33a1ea\"><i>WSJ<\/i><\/a>]<\/p>\n<p>Earlier this month, Genesis reached a tentative settlement agreement in New York\u2019s <a href=\"https:\/\/amycastor.com\/2023\/10\/30\/new-york-vs-dcg-genesis-and-gemini-kids-kids-youre-both-ugly\/\">fraud case against Genesis, DCG, and the Gemini crypto exchange<\/a> over Gemini Earn. The settlement has to be approved by the bankruptcy court. DCG has filed an objection to Genesis\u2019 settlement. DCG is concerned that Genesis is overpaying its creditors. They argue that the settlement violates the bankruptcy code because the payments are tied to the asset prices as of the distribution date, not the petition date. [<a href=\"https:\/\/www.coindesk.com\/policy\/2024\/02\/21\/dcg-calls-out-genesis-settlement-with-new-york-as-subversive\/\"><i>CoinDesk<\/i><\/a><i>; <\/i><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysb.314889\/gov.uscourts.nysb.314889.1341.0.pdf\"><i>Doc 1341<\/i><\/a><i>, PDF<\/i>]<\/p>\n<p>Meanwhile, New York is expanding the claims in the Gemini Earn case from $1 billion to $3 billion, because so many previously unknown victims came forward after the original filing. This is notwithstanding the agreement with Genesis to settle. [<a href=\"https:\/\/ag.ny.gov\/press-release\/2024\/attorney-general-james-expands-lawsuit-against-cryptocurrency-company-digital\"><i>Press release<\/i><\/a><i>; <\/i><a href=\"https:\/\/ag.ny.gov\/sites\/default\/files\/2024-02\/genesis-amended-complaint.pdf\"><i>amended complaint<\/i><\/a><i>, PDF<\/i>]<\/p>\n<p>Genesis also settled a separate case with New York in January over anti-money-laundering compliance failures. Genesis will pay a $8 million fine and surrender its BitLicense, meaning it can\u2019t operate in New York anymore. [<a href=\"https:\/\/www.dfs.ny.gov\/reports_and_publications\/press_releases\/pr2024011224\"><i>Press release<\/i><\/a><i>; <\/i><a href=\"https:\/\/www.dfs.ny.gov\/system\/files\/documents\/2024\/01\/ea20240104_genesis_global_trading_inc.pdf\"><i>consent order<\/i><\/a><i>, PDF<\/i>]<\/p>\n<h3>Absolute zero<\/h3>\n<p>Celsius Network is <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2024\/02\/03\/crypto-collapse-ftx-is-liquidating-and-getting-an-examiner-tethers-q4-attestation-more-etfs-coming\/\">paying out creditors<\/a> with what cash and liquid crypto is left \u2014 about $3 billion total. Crypto distributions to holders in the US are through PayPal\/Venmo while overseas holders are mainly managed by Coinbase. [<a href=\"https:\/\/www.businesswire.com\/news\/home\/20240131994097\/en\/\"><i>BusinessWire<\/i><\/a><i>; <\/i><a href=\"https:\/\/cases.stretto.com\/public\/x191\/11749\/PLEADINGS\/1174902162480000000009.pdf\"><i>Doc 4319<\/i><\/a><i>, PDF<\/i>]<\/p>\n<p>Things aren\u2019t going so smoothly. Coinbase has been flagging Celsius creditors for anti-money laundering issues. Several creditors are complaining that Coinbase has sent them notices with \u201cyour claim distribution cannot be serviced through Coinbase.\u201d [<a href=\"https:\/\/twitter.com\/cryptohunter0x\/status\/1758528377647251632\"><i>Twitter<\/i><\/a><i>, <\/i><a href=\"https:\/\/archive.ph\/aVHeL\"><i>archive<\/i><\/a><i>; <\/i><a href=\"https:\/\/twitter.com\/alesaria\/status\/1758661418491265211\"><i>Twitter<\/i><\/a><i>, <\/i><a href=\"https:\/\/archive.ph\/oM1r8\"><i>archive<\/i><\/a><i>; <\/i><a href=\"https:\/\/twitter.com\/stephent8t\/status\/1758524569286070752\"><i>Twitter<\/i><\/a><i>, <\/i><a href=\"https:\/\/archive.ph\/OqlRu\"><i>archive<\/i><\/a>]<\/p>\n<p>We\u2019re told by aggrieved Celsius creditors that the company is sending dollar payments out as US checks, which can\u2019t be cashed at all in many foreign countries. It\u2019s not clear what will be done about the Coinbase and US check issues. Celsius asks affected creditors to email them to arrange a wire transfer instead \u2014 though the company\u2019s autoresponder says that they\u2019re flooded with requests and are trying to get through the pile. [<a href=\"https:\/\/celsiusnetwork.medium.com\/celsius-distribution-faq-1cdd323251ef\"><i>Medium<\/i><\/a>]<\/p>\n<h3>The collapse: Su and Kyle&#8217;s bogus journey<\/h3>\n<p>Zhu Su and Kyle Davies, founders of crypto-market-crashing hedge fund Three Arrows Capital, have so far evaded criminal charges on 3AC\u2019s foolishness that in <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2022\/06\/22\/crypto-collapse-latest-the-contagion-spreads\/\">June 2022<\/a> killed the parts of the crypto market that hadn\u2019t been killed by <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2022\/05\/10\/terras-stablecoin-does-a-2008-crisis-ust-crashes-and-takes-bitcoin-with-it\/\">Terra-Luna in May.<\/a> But 3AC\u2019s creditors are now bringing billion-dollar claims against Zhu and Davies personally. And those creditors think some of the pair\u2019s statements in 3AC\u2019s last days look very like fraud. In the meantime, Zhu and Davies want to start a new exchange, OX.Fun, trading its own in-house meme tokens. [<a href=\"https:\/\/nymag.com\/intelligencer\/article\/how-su-zhu-and-kyle-davies-are-dodging-jail-and-rebranding.html\"><i>Intelligencer<\/i><\/a><i>, <\/i><a href=\"https:\/\/archive.is\/AcHL4\"><i>archive<\/i><\/a>]<\/p>\n<p>Do Kwon, cofounder of Terraform Labs, is set to be extradited from Montenegro to the US, where he will face <a href=\"https:\/\/amycastor.com\/2023\/03\/24\/do-kwon-arrested-white-house-hates-crypto-coinbase-wells-notice-sec-charges-justin-sun-signature-sold-ftx-bahamas-party-fund-returns\/\">criminal charges<\/a> over the Terra-Luna collapse. South Korea\u2019s application was rejected. Kwon had agreed to extradition but wanted to go to South Korea first. [<a href=\"https:\/\/www.pobjeda.me\/clanak\/do-kvon-bice-izrucen-sad-u\"><i>Pobjeda<\/i><\/a><i>, in Montenegrin<\/i>]<\/p>\n<p>Han Jang-Choon, the former CEO of Terraform Labs, who was also in custody in Montenegro, has been extradited to South Korea. Han was traveling with Do Kwon when they were both arrested last March. [<a href=\"https:\/\/www.coindesk.com\/policy\/2024\/02\/05\/former-terraform-labs-cfo-han-chang-joon-extradited-to-south-korea-by-montenegro\/\"><i>CoinDesk<\/i><\/a>]<\/p>\n<p>Consumer fraud could lead to a life sentence in South Korea for offenses over 5 billion won, or USD$3.8 million. Better not do any DeFi frauds that touch South Koreans, hey. [<a href=\"https:\/\/www.coindesk.com\/policy\/2024\/02\/07\/crypto-crime-could-mean-jail-for-life-in-south-korea\/\"><i>CoinDesk<\/i><\/a>]<\/p>\n<p>Crypto trading and custody platform Bakkt is broke. The company filed a significant new risk factor with the SEC: \u201cWe might not be able to continue as a going concern.\u201d They need significant new revenue not to die within 12 months. Baakt also noted that the NYSE may delist its stock (BKKT). The stock was at $42.52 in October 2021; it\u2019s now around $0.96. [<a href=\"https:\/\/www.sec.gov\/Archives\/edgar\/data\/1820302\/000182030224000011\/bakkt-20230930.htm\"><i>10-Q\/A<\/i><\/a>]<\/p>\n<p>Coinbase\u2019s 10-K for 2023 is in! There\u2019s no real news since <a href=\"https:\/\/amycastor.com\/2023\/11\/07\/coinbase-q3-earnings-regulatory-clarity-is-all-we-need-and-a-miracle-or-two\/\">their Q3 2023 filings<\/a>. Retail trading is through the floor \u2014 so if anyone claims the crypto market is definitely coming back any moment now, that\u2019s just incorrect. But Coinbase\u2019s total revenue is up over 2022 because their share of the USDC stablecoin backing reserve generates interest income now. And they\u2019re looking forward to ETF custody income. [<a href=\"https:\/\/s27.q4cdn.com\/397450999\/files\/doc_downloads\/2024\/Coinbase-Q4-23-10K.pdf\"><i>10-K<\/i><\/a><i>, PDF<\/i>]<\/p>\n<h3>Craigness<\/h3>\n<p>Thankfully Craig Wright isn\u2019t really on-topic for the crypto collapse, so we don\u2019t have to think about him too much. But he\u2019s currently in court in the UK \u2014 the Crypto Open Patent Alliance, backed by wealthy coiners including Twitter cofounder Jack Dorsey, seeks to prove that Wright\u2019s claims to be Satoshi Nakamoto are lies backed only by forged documents. They&#8217;re heartily sick of him suing people.<\/p>\n<p>The trial is bringing the comedy gold. The latest is that Wright has dismissed his own expert witnesses. We recommend CoinDesk\u2019s coverage. [<a href=\"https:\/\/www.coindesk.com\/tag\/craig-wright\/\"><i>CoinDesk<\/i><\/a>]<\/p>\n<p>Rory Cellan-Jones, in his time at the BBC, was one of the three journalists who suffered the Craig as Satoshi public relations offensive in 2016. [<a href=\"https:\/\/rorycellanjones.substack.com\/p\/the-battle-of-bitcoin\"><i>blog post<\/i><\/a><i>; <\/i><a href=\"https:\/\/noderunners.network\/en\/media\/media\/dr-bitcoin-the-man-who-wasnt-satoshi-nakamoto\/interview-with-rory-cellan-jones\/155115\"><i>podcast<\/i><\/a>]<\/p>\n<h3>More good news for bitcoin<\/h3>\n<p>Shan Hanes, the former CEO of the collapsed <a href=\"https:\/\/amycastor.com\/2023\/08\/15\/crypto-collapse-sam-bankman-fried-goes-to-jail-sec-appeals-ripple-ruling-prime-trust-bankrupt-the-tangled-tale-of-trueusd-and-tron\/\">Heartland Tri-State Bank<\/a>, has been charged with embezzlement. Hanes allegedly took $47.1 million from the accounts of a local church and a local investment club and gambled it on a crypto <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2023\/11\/02\/crypto-collapse-bankman-fried-trial-draws-to-a-close-safemoon-arrested-fourth-us-bank-failure-was-crypto\/\">pig-butchering scam<\/a>. This is the CEO of a bank falling for a cheap crypto scam. [<a href=\"https:\/\/www.americanbanker.com\/news\/ex-ceo-of-failed-kansas-bank-charged-with-embezzling-47-million\"><i>American Banker<\/i><\/a><i>, <\/i><a href=\"https:\/\/archive.is\/HptRA\"><i>archive<\/i><\/a>]<\/p>\n<p>Google decided to allow ads for bitcoin ETFs \u2014 so the ETF promoters are frantically spending on Google ads. [<a href=\"https:\/\/www.ft.com\/content\/170630c6-fc2e-43a2-90ca-5d45f4867657\"><i>FT<\/i><\/a><i>, <\/i><a href=\"http:\/\/archive.today\/2024.02.05-123519\/https:\/\/www.ft.com\/content\/170630c6-fc2e-43a2-90ca-5d45f4867657\"><i>archive<\/i><\/a>]<\/p>\n<p>Tether use case: illegal gambling. Billions of \u201cdollars\u201d in USDT are flowing around Southeast Asia-based illegal betting operations. [<a href=\"https:\/\/www.asianracing.org\/email\/202401qb-how-illegal-betting-and-related-money-laundering-flourished-despite-crypto-winter\"><i>Asian Racing<\/i><\/a>]<\/p>\n<p>The SEC has a new rule: almost any intermediaries in movements of securities who \u201ctake on significant liquidity-providing roles in the markets\u201d have to register as dealers. This is likely to also affect any DeFi operations that are effectively market makers for unregistered crypto securities \u2014 such as pretty much all DeFi tokens. Crypto traders asked for a special carveout; the SEC suggested they stop doing securities trading without registering. \u201cThe commission is not excluding any particular type of securities, including crypto asset securities, from the application of the final rules.\u201d [<a href=\"https:\/\/www.sec.gov\/news\/press-release\/2024-14\"><i>press release<\/i><\/a><i>; <\/i><a href=\"https:\/\/www.sec.gov\/files\/34-99477-fact-sheet.pdf\"><i>fact sheet<\/i><\/a><i>, PDF; <\/i><a href=\"https:\/\/www.federalregister.gov\/documents\/2022\/04\/18\/2022-06960\/further-definition-of-as-a-part-of-a-regular-business-in-the-definition-of-dealer-and-government\"><i>rule<\/i><\/a><i>; <\/i><a href=\"https:\/\/www.sec.gov\/comments\/s7-12-22\/s71222.htm\"><i>comments<\/i><\/a><i>; <\/i><a href=\"https:\/\/www.coindesk.com\/policy\/2024\/02\/06\/us-sec-clears-dealer-rule-expansion-that-could-rope-in-defi\/\"><i>CoinDesk<\/i><\/a>]<\/p>\n<p>Circle is dropping support for USDC on the Tron blockchain immediately. No reason was given \u2014 but we\u2019re not surprised, given <a href=\"https:\/\/amycastor.com\/2023\/03\/24\/do-kwon-arrested-white-house-hates-crypto-coinbase-wells-notice-sec-charges-justin-sun-signature-sold-ftx-bahamas-party-fund-returns\/\">the SEC charged Justin Sun<\/a>, the owner of Tron, with fraud last year, and Circle is hoping to go public sometime soon. Tron remains a favorite of Tether, which still relies on Tron to carry more than half of its USDT. [<a href=\"https:\/\/www.circle.com\/blog\/circle-is-discontinuing-support-for-usdc-on-the-tron-blockchain\"><i>Circle<\/i><\/a>]<\/p>\n<p>The European Central Bank says bitcoin is still trash. Its fair value is still zero, it hurts the environment, it\u2019s a market for fraud, and the ETF rally is just a dead cat bounce.
