[<a href=\"https:\/\/protos.com\/scoop-tethers-political-ties-with-new-banking-partner-britannia\/\"><i>Protos<\/i><\/a>]<\/p>\n<p>This is the third Bahamas-based bank that Tether has used to process US dollar transfers for its $82 billion stablecoin. The other two are Deltec and Capital Union Bank, at least as of March 2023.<\/p>\n<p>The new banking relationship follows <a href=\"https:\/\/amycastor.com\/2023\/03\/14\/crypto-collapse-signature-bank-blows-up-us-crypto-frantically-looks-for-banking\/\">Signature Bank shutting down in March<\/a> and crypto being effectively shut out of the US banking system. <a href=\"https:\/\/amycastor.com\/2023\/04\/16\/crypto-collapse-treasury-comes-after-defi-sec-comes-after-crypto-exchanges-stablecoin-bill-ftx-first-interim-report\/\">Tether was a client of Signature<\/a> and relied on Signet, the bank\u2019s real-time payment system for crypto exchanges, to do transfers of US dollars.<\/p>\n<p>Britannia Bank is part of the Britannia Financial Group, headquartered in London. The group has been getting into crypto. Its CEO Mark Bruce previously worked at Jump Trading. Earlier this year, Britannia Financial Group acquired crypto trading firm Alphaplate. [<a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2023-08-29\/tether-usdt-adds-bahamas-based-britannia-bank-trust-as-banking-partner\"><i>Bloomberg<\/i><\/a><i>, <\/i><a href=\"https:\/\/archive.ph\/2iBYt\"><i>archive<\/i><\/a>]<\/p>\n<p>The founder of Britannia Financial Group is Italian-Venezuelan billionaire Julio Martin Herrera Velutini, who created Britannia by merging several other financial services firms. Last year, the US Department of Justice charged Velutini with bribing Puerto Rican officials. As he awaits trial, his twenty-something son Julio Cesar Herrera has been stepping up to take control of Britannia.<\/p>\n<p>The elder Herrera is also a major donor to the UK Conservative Party through Britannia Financial Group. [<a href=\"https:\/\/www.bbc.com\/news\/uk-politics-62754148\"><i>BBC<\/i><\/a><i>, 2022<\/i>]<\/p>\n<h3>Everybody still hates Binance<\/h3>\n<p>The SEC has filed a document under seal in <a href=\"https:\/\/amycastor.com\/2023\/06\/12\/sec-sues-binance-part-1-the-complaint-binance-us-asset-freeze-tai-chi-plan-sock-puppet-ceos-weird-cash-flows\/\">its civil suit against Binance<\/a>, with a huge pile of exhibits attached. [<i>Doc 102; <\/i><a href=\"https:\/\/www.courtlistener.com\/docket\/67474542\/securities-and-exchange-commission-v-binance-holdings-limited\/?filed_after=&amp;filed_before=&amp;entry_gte=&amp;entry_lte=&amp;order_by=desc\"><i>case docket<\/i><\/a>]<\/p>\n<p>This is an extremely rare move for the SEC. John Reed Stark thinks the SEC may be working with the Department of Justice and doesn\u2019t want to do anything that might interfere with a potential criminal investigation. <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2023\/03\/28\/cftc-cracks-czs-phone-sues-binance-whats-a-little-terrorist-financing-between-friends\/\">We\u2019re already pretty sure<\/a> there\u2019s a sealed criminal indictment with CZ\u2019s name on it waiting for him to set foot outside Dubai. [<em><a href=\"https:\/\/twitter.com\/JohnReedStark\/status\/1696514650966212651\">Twitter<\/a>, <a href=\"https:\/\/archive.ph\/7h0dD\">archive<\/a><\/em>]<\/p>\n<p>Binance\u2019s BUSD stablecoin is a dead coin walking since Paxos <a href=\"https:\/\/amycastor.com\/2023\/02\/15\/crypto-collapse-binance-usd-shut-down-celsius-insiders-sued-paxos-voyager-ftx\/\">shut down<\/a> further issuance in February this year. Binance is finally shutting down its remaining <a href=\"https:\/\/amycastor.com\/2023\/01\/08\/crypto-collapse-dcgs-problem-is-grayscale-ftx-bahamas-agreement-defi-trading-arrest-silvergate-bank-huobi-binance\/\">pegged copies of BUSD<\/a> on other blockchains and removing BUSD trading pairs from the exchange. Customers are encouraged to change their BUSD for <a href=\"https:\/\/amycastor.com\/2023\/08\/03\/crypto-collapse-terra-judge-repudiates-ripple-finding-razzlekhan-cops-a-plea-binances-fdusd-stablecoin-coindesk-sold-smart-contracts-still-stupid\/\">FDUSD, Binance\u2019s new favorite<\/a> stablecoin. [<a href=\"https:\/\/www.binance.com\/en\/support\/announcement\/binance-encourages-users-to-convert-busd-to-other-stablecoins-prior-to-february-2024-d392843e81fd4bc3a5f7e219aa01f34d\"><i>Binance<\/i><\/a>]<\/p>\n<p>Binance is using its charity arm to do some academic-washing. Binance Charity has donated $300,000 \u2014 in crypto \u2014 for a Metaverse Lab at the University of Western Australia and some master&#8217;s courses in the School of Business. [<a href=\"https:\/\/www.digitalnationaus.com.au\/news\/binance-funds-blockchain-course-masters-and-metaverse-lab-at-uwa-586407\"><i>Digital Nation<\/i><\/a>]<\/p>\n<h3>PYUSD: A coin left in a stable<\/h3>\n<p>Nobody uses PayPal\u2019s PYUSD stablecoin, <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2023\/08\/09\/crypto-collapse-the-fed-takes-on-crypto-banks-coinbase-earnings-call-is-bad-ftx-2-ex-harder\/\">which launched on August 10<\/a>. Aside from smart contracts and exchanges, only ten holders have a balance of more than $1,000. [<a href=\"https:\/\/www.theblock.co\/post\/247553\/paypals-new-stablecoin-facing-sluggish-demand-from-crypto-users-nansen-says\"><i>The Block<\/i><\/a>]<\/p>\n<p>The price is thin and super shaky, bouncing between $1.00 and $1.01. PYUSD is currently listed on Coinbase, Kraken, and Crypto.com \u2014 but volume is on the order of $45,000 per day on $27 million of issuance. [<a href=\"https:\/\/www.coingecko.com\/en\/coins\/paypal-usd\"><i>CoinGecko<\/i><\/a>]<\/p>\n<p>Arthur E. Wilmarth Jr., a law professor at George Washington University Law School, says Congress needs to stop PayPal and other non-banks from issuing stablecoins. He thinks a default on PayPal in liabilities \u2014 if they had a large issuance, faced a run on the bank, and were unable to redeem their stablecoins \u2014 could create a broader financial crisis. All stablecoin issuers should be regulated like banks, he says. We agree. Stablecoins are reminiscent of the <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2021\/01\/21\/stablecoins-through-history-michigan-bank-commissioners-report-1839\/\">wildcat banking era<\/a>. [<a href=\"https:\/\/www.americanbanker.com\/opinion\/paypals-stablecoin-plan-poses-a-grave-threat-to-financial-stability\"><i>American Banker,<\/i><\/a><i> paywalled, <\/i><a href=\"https:\/\/archive.ph\/qGANQ\"><i>archive<\/i><\/a>]<\/p>\n<h3>Not being able to live within 500 feet of a school is a small price to pay for true freedom<\/h3>\n<p>We\u2019re beginning to think that Avi Eisenberg, the hotshot DeFi trader who <a href=\"https:\/\/amycastor.com\/2023\/01\/08\/crypto-collapse-dcgs-problem-is-grayscale-ftx-bahamas-agreement-defi-trading-arrest-silvergate-bank-huobi-binance\/\">drained Mango Markets of $110 million<\/a>, may potentially not be the most media-friendly example of a valiant DeFi freedom fighter.<\/p>\n<p>In its response to Eisenberg\u2019s motion to dismiss the criminal charges against him, the US government explains why Avi can\u2019t have his cellphones or laptop back after they were seized in Puerto Rico: [<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.592131\/gov.uscourts.nysd.592131.36.0.pdf\"><i>Doc 36<\/i><\/a><i>, PDF<\/i>]<\/p>\n<blockquote><p>While converting data from one of Eisenberg\u2019s cellphones into a readable format, CART employees observed that the device contained child pornography. On or about February 6, 2023, the Government applied for and obtained a second warrant, expanding the scope of the original warrant to search for evidence of offense related to the possession and receipt of child pornography.<\/p>\n<p>&#8230; focusing on the full period since the seizure is inappropriate because, as Eisenberg well knows, he is not able to get back his devices because they contain child pornography. The Government found child pornography on one of the Cellphones by early February and has since found child pornography on the Laptop and the other operable Cellphone.<\/p><\/blockquote>\n<p>Some in the crypto world are certain the US government planted the material on Eisenberg\u2019s phones. These tend to be the same sort of guys who think the US government somehow entrapped poor innocent 30-year-old bitcoin ancap Cody Wilson into having sex with a 16-year-old. [<a href=\"https:\/\/twitter.com\/davidgerard\/status\/1164642687343087616\"><i>Twitter<\/i><\/a><i>, 2019, <\/i><a href=\"http:\/\/web.archive.org\/web\/20190824201619\/https:\/\/twitter.com\/davidgerard\/status\/1164642687343087616\"><i>archive<\/i><\/a>]<\/p>\n<p>But that\u2019s just a side issue here. Almost all normal practice in DeFi has always been straight-up illegal under US law. Almost every token was always an unregistered security.<\/p>\n<p>The prosecution of Eisenberg is extremely bad news for <em>all<\/em> the DeFi traders who have been conscientiously racking up prosecution futures on permanent public blockchains.<\/p>\n<p>Eisenberg was correct when he said that what he did was entirely normal for DeFi \u2014 but it\u2019s also been illegal under Dodd-Frank since 2010. These are actual market crimes with actual victims in those markets.<\/p>\n<p>But worse, the inflated valuations of crypto tokens are <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2023\/05\/07\/crypto-collapse-one-year-since-terra-luna-new-york-goes-after-crypto-coinbase-launches-offshore-casino-central-african-republic-abandons-bitcoin\/\">accounted as mark-to-market<\/a>. This makes DeFi shenanigans into <i>large and serious<\/i> crimes just by their dollar value. Whoops.<\/p>\n<p>That&#8217;s arguably unfair because the realizable value of these utterly illiquid magic beans is much lower than their mark-to-market value. Maybe Avi\u2019s lawyer can argue that. But his lawyer can\u2019t argue that what his client did wasn\u2019t illegal.<\/p>\n<p>In fact, Eisenberg\u2019s lawyer can\u2019t even argue that his client didn\u2019t realize that what he was doing was illegal. As the DoJ mentions in their filing, Eisenberg previously sued someone else for the same sort of shenanigans, arguing that the other guy\u2019s actions were illegal under these very laws.<\/p>\n<h3>Overflowing the crime counter<\/h3>\n<p>Sam Bankman-Fried is so unhappy with his present pre-trial remand conditions that he\u2019s been skipping meetings with his lawyers. The US Government notes: \u201cRemarkably, after only two prior sessions, the defendant declined this week to take advantage of this accommodation, citing dissatisfaction with the conditions that it comes with.\u201d Poor lamb.<\/p>\n<p>Sam\u2019s lawyers complained of the volume of discovery \u2014 four million pages of evidence, presented just six weeks before trial. They asked for the fresh evidence to be excluded from the trial.<\/p>\n<p>Judge Lewis Kaplan declined the request. He instead suggested the defense ask for an extension to deal with the extra material if they really wanted one. It turns out they didn\u2019t \u2014 they had until September 1 to request a postponement of the trial and didn\u2019t ask for one. If Sam didn\u2019t want four million pages of evidence submitted, a good start would have been not to commit four million pages of crimes. The trial is still on for October 2. [<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.590940\/gov.uscourts.nysd.590940.228.0.pdf\"><i>Doc 228<\/i><\/a><i>, PDF; <\/i><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.590940\/gov.uscourts.nysd.590940.238.0.pdf\"><i>Doc 238<\/i><\/a><i>, PDF; <\/i><a href=\"https:\/\/twitter.com\/innercitypress\/status\/1696939001364550072\"><i>Twitter<\/i><\/a><i>, <\/i><a href=\"https:\/\/archive.ph\/wip\/HwGVB\"><i>archive<\/i><\/a>]<\/p>\n<p>Robinhood has agreed with the US Marshal Service to buy back $605.7 million in stock (HOOD) <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2023\/07\/30\/john-jay-ray-sues-ftx-inner-circle-for-1-billion-prosecutors-want-sam-bankman-frieds-bail-revoked\/\">previously owned by Sam<\/a> through his firm Emergent Development Technologies. The sale was approved by the US District Court for SDNY, as revealed in a recent Robinhood SEC filing. [<a href=\"https:\/\/www.sec.gov\/Archives\/edgar\/data\/1783879\/000178387923000201\/hood-20230830.htm\"><i>Form 8-K<\/i><\/a>]<\/p>\n<h3>Good news for bitcoin<\/h3>\n<p>Grayscale applied to turn <a href=\"https:\/\/amycastor.com\/2022\/04\/19\/welcome-to-grayscales-hotel-california\/\">GBTC<\/a> into a bitcoin exchange-traded fund. The SEC <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2022\/08\/01\/crypto-collapse-3acs-grayscale-two-step-and-where-in-the-world-are-zhu-and-davies\/\">rejected<\/a> Grayscale\u2019s ETF application. Grayscale <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2022\/10\/18\/news-us-treasury-on-the-threat-of-crypto-failed-corporate-nfts-sec-vs-yuga-labs-urbit-tries-again\/\">appealed<\/a> \u2014 and the District of Columbia Court of Appeals has ruled that the SEC\u2019s rejection was \u201carbitrary and capricious,\u201d given they\u2019d previously allowed a bitcoin futures ETF. This doesn\u2019t mean that Grayscale necessarily gets its ETF \u2014 it means that the SEC could appeal the appeal, or it could rule again on Grayscale\u2019s original application, or Grayscale may have to restart the application process from scratch. [<a href=\"https:\/\/www.reuters.com\/business\/finance\/whats-stake-grayscales-spot-bitcoin-etf-case-against-sec-2023-08-29\/\"><i>Reuters<\/i><\/a>]<\/p>\n<p>The SEC has delayed its response to a pile of other bitcoin ETF applications. [<a href=\"https:\/\/www.reuters.com\/technology\/us-sec-delays-decision-invesco-wisdomtree-valkyrie-bitcoin-etfs-2023-08-31\/\"><i>Reuters<\/i><\/a>]<\/p>\n<p>In the Genesis bankruptcy, the unsecured creditors\u2019 committee has made a deal with Genesis and its owner Digital Currency Group that would give creditors recovery of 70% to 90%! If they&#8217;re willing to account IOUs from DCG as money \u2014 and never mind <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2023\/02\/12\/crypto-collapse-unbanking-crypto-genesis-offers-dcg-shares-to-creditors-binance-suspends-us-dollar-transactions-sec-goes-after-staking\/\">that\u2019s how Genesis got into this state<\/a>. If you don&#8217;t count the promise of future DCG magic beans, recovery would be on the order of 20%. A lot of other creditors are not happy at all with the deal, including the Gemini exchange, which is currently <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2023\/07\/15\/crypto-collapse-alex-mashinsky-of-celsius-arrested-ripples-bizarre-xrp-win-gemini-sues-genesis-gisele-bundchen-knew-nothing\/\">suing DCG<\/a> for the money its subsidiary Genesis owes them. [<a href=\"https:\/\/www.wsj.com\/articles\/genesis-creditors-forge-new-chapter-11-deal-with-parent-digital-currency-group-6bb209ba\"><i>WSJ<\/i><\/a><i>, <\/i><a href=\"https:\/\/archive.is\/I20Bn\"><i>archive<\/i><\/a>]<\/p>\n<p>Is there anything NFTs can\u2019t do? Impact Theory just settled with the SEC for offering NFTs in the manner of investment contracts \u2014 <i>i.e.<\/i>, securities. Impact Theory paid a disgorgement of $5,120,718.27, prejudgment interest of $483,195.90, and a civil money penalty of $500,000.
