Wright<\/a> is the lawsuit about the one million bitcoins that Craig Wright says he mined as Satoshi Nakamoto, the creator of Bitcoin. Wright has previously said he created Bitcoin with his old friend Dave Kleiman, who died in 2013. Kleiman&#8217;s brother Ira asks: so where&#8217;s Dave&#8217;s half? After three and a half years, the trial has finally started. [<a href=\"https:\/\/www.courtlistener.com\/docket\/6309656\/kleiman-v-wright\/?page=5\"><i>case docket<\/i><\/a>]<\/p>\n<p>So far, the plaintiffs have presented Wright\u2019s previous statements and affidavits, and how they contradict his present claims. Wright says that the documents don\u2019t mean what they clearly appear to mean. Andrew O\u2019Hagan, who wrote \u201cThe Satoshi Affair\u201d for London Review of Books in 2016, has said that Wright told him Dave Kleiman helped with the technical side of Bitcoin. [<em><a href=\"https:\/\/www.law360.com\/articles\/1438959\">Law360<\/a>, paywalled; <a href=\"https:\/\/www.coindesk.com\/policy\/2021\/11\/02\/kleiman-v-wright-bitcoins-trial-of-the-century-kicks-off-in-miami\/\">CoinDesk<\/a><\/em>]<\/p>\n<p>Wright\u2019s defences are that he didn\u2019t have a written contract with Kleiman. And that he\u2019s autistic. Yes, that&#8217;s really his defence.<\/p>\n<p>Both sides assume for the purposes of this case that Wright was Satoshi. Back here in the real world, that\u2019s considered rather unlikely. Former Bitcoin lead developer Gavin Andresen testified to this effect in a video deposition: \u201cThe gobbledygook proof he published was certainly a deception, if not an outright lie. The awful <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2020\/06\/21\/news-estonia-not-so-keen-on-crypto-peter-todd-settles-sexual-assault-defamation-claim-how-compound-works-bye-bye-wirecard\/\">Community Points scheme<\/a> will be deployed across the discussion site Reddit. [<em><a href=\"https:\/\/www.reddit.com\/community-points\">Reddit<\/a>; Twitter, <a href=\"https:\/\/archive.md\/w7Wd1\">archive<\/a><\/em>]<\/p>\n<p>On Reddit, you have posts and comments on the posts. These can be voted up or down, and the total is called your &#8220;karma.&#8221; The Community Points scheme makes these upvotes and downvotes into crypto tokens. Your collected upvotes and downvotes will become saleable commodities. You can literally <i>buy<\/i> popularity!<\/p>\n<p>The points will be stored on the public Ethereum blockchain. Ethereum doesn\u2019t scale \u2014 so Reddit is doing this through a centralised aggregator, Arbitrum. [<a href=\"https:\/\/www.reddit.com\/r\/ethereum\/comments\/opi5rg\/scaling_reddits_community_points_with_arbitrum\/\"><em>Reddit<\/em><\/a>]<\/p>\n<p>The original Twitter announcement was deleted after a massive negative reaction from the remaining Reddit user base. The &#8220;Community Points&#8221; page is still there, however.<\/p>\n<p>When Second Life put in a scheme in 2005 to turn reputation points into Linden Dollars, mutual-upvote \u201crep parties\u201d immediately sprang up. Gox crypto exchange closed in 2014 and went into bankruptcy, after they had to admit that <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2017\/09\/17\/kim-nilsson-of-wizsec-how-the-bitcoins-were-stolen-from-mt-gox\/\">most of the bitcoins had been stolen.<\/a><\/p>\n<p>Since then, the price of Bitcoin has gone up considerably. So rather than being paid out in cash, the creditors wondered if they could have the remaining bitcoins that the trustee recovered. This is far less an amount of bitcoins than was lost, but much more nominal value.<\/p>\n<p>This Bitcoin-based rehabilitation plan was approved by 99% of creditors on 20 October. Now we await a massive quantity of bitcoins being dumped on the market. [<a href=\"https:\/\/www.mtgox.com\/img\/pdf\/20211020_announcement_en.pdf\"><i>Mt. So far, it&#8217;s providing the same quality of service that Coinbase users have long been used to. &#8220;You know what Coinbase did two days after I got hacked? They sent me a customer survey and they asked me to rate their service.&#8221; [<a href=\"https:\/\/www.cnbc.com\/2021\/10\/12\/coinbase-users-slam-new-customer-service-phone-support.html\"><i>CNBC<\/i><\/a>]<\/p>\n<p>Crypto is most usefully viewed not as a varied and robust market, but as <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2020\/09\/06\/the-crypto-market-as-a-single-unified-scam\/\">a single unified scam casino.<\/a> Coin ownership, control and mining are centralised to a very small number of individual actors. You knew this already, but the National Bureau of Economic Research brings the numbers afresh. [<a href=\"https:\/\/www.nber.org\/system\/files\/working_papers\/w29396\/w29396.pdf\"><i>NBER<\/i><\/a><i>, PDF<\/i>]<\/p>\n<p>The Bank of England talks up the risks of crypto trading to real-world markets. The bank should know better than to take the \u201cmarket cap\u201d of Bitcoin seriously \u2014 but this is what crypto gets for working so hard to promote a big number that\u2019s bogus. A more real-world number is that the bank estimates $40 billion has been borrowed to buy into cryptos, and so that\u2019s real debt that&#8217;s a real risk. Specifically, it was a Binance Smart Chain rugpull. [<a href=\"https:\/\/www.vice.com\/en\/article\/n7nw4k\/unbelievable-monkey-jizz-cryptocurrency-turns-out-to-be-a-scam\"><i>Vice<\/i><\/a>]<\/p>\n<p>The New York Attorney General has told two unnamed DeFi lenders to cease operations in New York, and three more to provide information. The NYAG press release didn\u2019t name the companies \u2014 but early versions of the redacted PDFs had the names of the companies in the document\u2019s titles. Nexo was kicked out of New York, and Celsius was asked to provide more information. This time: Cream, taken for $130 million of ETH in a flash-loan attack. VanEck&#8217;s latest application was rejected for the same reason the SEC has rejected every Bitcoin ETF since 2015 \u2014 the\u00a0 Bitcoin market is trash, full of \u201cfraudulent and manipulative acts and practices.\u201d The SEC also mentions \u201cmanipulative activity involving the purported \u2018stablecoin\u2019 Tether.\u201d [<a href=\"https:\/\/www.sec.gov\/rules\/sro\/cboebzx\/2021\/34-93559.pdf\"><i>SEC<\/i><\/a><i>, PDF<\/i>]<\/p>\n<p>I&#8217;m actually surprised the SEC let Proshares\u2019 Bitcoin futures ETF go through. This ETF tracks the Bitcoin futures on CME \u2014 possibly the only safe way to short Bitcoin, though CME&#8217;s product is only available to accredited investors. I guess the SEC figured that if the CME Bitcoin futures were fine with the CFTC, well, <i>fine.<\/i> [<a href=\"https:\/\/www.sec.gov\/Archives\/edgar\/data\/0001174610\/000168386321006052\/f10028d1.htm\"><i>SEC filing<\/i><\/a>]<\/p>\n<p>Wyoming blockchain company American CryptoFed DAO filed with the SEC in September to become a public company, and register its Locke and Ducat tokens as securities! The SEC was so unimpressed, they got a court order to stop this. You really don\u2019t want to get an SEC order that says \u201cmaterially misleading\u201d as often as this one does.<\/p>\n<p>American CryptoFed said they were registering the Locke and Ducat tokens as securities, then filed a form saying the tokens <em>weren\u2019t<\/em> securities. (They appear to be securities.) Also, you can\u2019t distribute shares under an employee benefit plan when you brag that your DAO doesn\u2019t have employees. American CryptoFed has ten days to respond, and a hearing will be arranged after that. [<a href=\"https:\/\/www.prnewswire.com\/news-releases\/american-cryptofed-dao-files-with-the-sec-to-be-a-public-company-301379838.html\"><i>American CryptoFed press release<\/i><\/a><i>; <\/i><a href=\"https:\/\/www.sec.gov\/news\/press-release\/2021-231\"><i>SEC press release<\/i><\/a><i>; <\/i><a href=\"https:\/\/www.sec.gov\/litigation\/admin\/2021\/34-93551.pdf\"><i>SEC order<\/i><\/a><i>, PDF<\/i>]<\/p>\n<p>Bitqyck was a crypto fraud in Dallas, Texas that scammed $24 million from about <i>thirteen thousand<\/i> investors. Bruce Bise and Samuel Mendez said that their coins Bitqy and BitqyM came with a share of their company\u2019s stock. Of course, Bise and Mendez kept the money. The <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2019\/09\/02\/news-tether-clogs-ethereum-quadriga-venue-move-kodakone-sends-copyright-trolling-email-telegram-ton-proceeding-no-official-chinese-stablecoin-lightning-in-decline-dont-be-your-own-bank\/\">SEC busted Bise and Mendez in 2019,<\/a> for disgorgement of $8,375,617 and fines of $890,254 and $850,022; the IRS got them for tax fraud in mid-October. [<a href=\"https:\/\/www.dallasobserver.com\/news\/dallas-based-crypto-fraud-scammed-13000-out-of-24-million-before-pleading-guilty-to-tax-evasion-12612291\"><i>Dallas Observer<\/i><\/a><i>; <\/i><a href=\"https:\/\/www.sec.gov\/litigation\/litreleases\/2019\/lr24582.htm\"><i>SEC press release<\/i><\/a><i>, 2019; <\/i><a href=\"https:\/\/www.justice.gov\/usao-ndtx\/pr\/founders-crypto-ico-plead-guilty-tax-evasion-after-raising-24-million-investors\"><i>Justice Department press release<\/i><\/a>]<\/p>\n<p>Recent headlines: \u201cJury finds crypto asset not a security!\u201d This is a ruling in the last dregs of an investor action against Josh Garza\u2019s GAW Miners cloud-mining scam from 2014 and 2015, before Garza went to jail. GAW sold \u201chashlets,\u201d that would represent a portion of the company\u2019s alleged mining power. The jury found that the investors had sufficient control of the hashlets that they didn\u2019t count as passive investments, and thus weren&#8217;t a pure investment contract. [<a href=\"https:\/\/www.law360.com\/articles\/1436790\"><i>Law360<\/i><\/a>]<\/p>\n<p>&nbsp;<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The claims that \u201ccrypto isn\u2019t just used for money laundering\u201d and \u201ccrypto is becoming economically significant to Miami\u201d are somewhat in tension<\/p>\n<p>&mdash; Robinson Meyer (@yayitsrob) <a href=\"https:\/\/twitter.com\/yayitsrob\/status\/1442980693244588032?ref_src=twsrc%5Etfw\">September 28, 2021<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>&nbsp;<\/p>\n<h3>Monkey laundering<\/h3>\n<p>Fight For the Future puts itself forward as a civil liberties organisation concerned with the Internet, in the manner of the EFF or the Open Rights Group. Except that every single thing FFTF do seems to have a blockchain grift bolted on. I mean, it\u2019s quite possible they\u2019ve done things that didn\u2019t have a blockchain grift bolted on, and I just failed to notice those rare examples.<\/p>\n<p>In Twitter discussion, FFTF principals have repeatedly refused to disclose their crypto asset holdings \u2014 even as they promote cryptocurrency unceasingly. At this stage, they should definitely be called Fight For Our Hodling.<\/p>\n<p>Today\u2019s egregious example is when game developer Valve banned NFTs and blockchain scam games from the Steam marketplace in early October \u2014 \u201cApplications built on blockchain technology that issue or allow exchange of cryptocurrencies or NFTs\u201d. FFTF joined a pile of NFT developers in writing a letter of protest to Valve over this obviously good and sensible move. I didn\u2019t know before that selling cryptos inside video games on a proprietary platform is a valuable civil liberty. In fact, I still don\u2019t. Kotaku linked Stephen Diehl\u2019s Twitter thread on why NFTs are a scam. [<em><a href=\"https:\/\/partner.steamgames.com\/doc\/gettingstarted\/onboarding?l=english\">Valve<\/a>; <a href=\"https:\/\/kotaku.com\/good-riddance-steam-bans-games-that-feature-crypto-and-1847874385\">Kotaku<\/a>; <a href=\"https:\/\/kotaku.com\/26-nft-developers-send-very-sad-letter-to-valve-after-s-1847959748\">Kotaku<\/a>; <a href=\"https:\/\/twitter.com\/smdiehl\/status\/1445795667826208770\">Twitter<\/a><\/em>]<\/p>\n<p>Ed Zitron: \u201cThe NFT industry is just another way rich people have found to enrich themselves by selling people the idea that they too could be rich if only they participated in the scheme that enriched the rich people first.
