{"id":15291,"date":"2019-12-22T22:20:42","date_gmt":"2019-12-22T22:20:42","guid":{"rendered":"https:\/\/davidgerard.co.uk\/blockchain\/?p=15291"},"modified":"2019-12-23T12:38:11","modified_gmt":"2019-12-23T12:38:11","slug":"news-kraken-trouble-in-wyoming-reggie-fowler-plea-deal-australia-clamps-down-on-crypto-exchanges","status":"publish","type":"post","link":"https:\/\/davidgerard.co.uk\/blockchain\/2019\/12\/22\/news-kraken-trouble-in-wyoming-reggie-fowler-plea-deal-australia-clamps-down-on-crypto-exchanges\/","title":{"rendered":"News: Kraken trouble in Wyoming, Reggie Fowler plea deal, Australia clamps down on crypto exchanges"},"content":{"rendered":"<p>The <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2019\/12\/17\/kraken-exchange-sued-by-whistleblowing-ex-employee-allegations\/\">shocking allegations against the Kraken crypto exchange<\/a> \u2014  which I broke the story on, and you can <a href=\"https:\/\/www.patreon.com\/davidgerard\/overview\">thank me at the Patreon!<\/a> \u2014 just <a href=\"https:\/\/web.archive.org\/web\/20191220170226\/https:\/\/trib.com\/news\/state-and-regional\/govt-and-politics\/kraken-a-major-crypto-firm-eyeing-wyoming-at-center-of\/article_f2b7f6b6-a859-565b-9d73-bf5d0bc636f7.html\">made the mainstream press<\/a> &#8230; and may cause issues with Kraken&#8217;s plans in Wyoming.<\/p>\n<p>Kraken were hoping to use Wyoming&#8217;s somewhat indulgent &#8220;blockchain&#8221; laws \u2014 largely <a href=\"https:\/\/www.wyofile.com\/links-drive-allegation-of-insiders-writing-crypto-bills\/\">written by the crypto industry<\/a> \u2014 to get a local banking charter. They hoped to use this as a <a href=\"https:\/\/www.coindesk.com\/kraken-job-ad-hints-at-plan-to-build-special-purpose-wyoming-bank\">back door into New York state<\/a> \u2014 without getting the New York BitLicense they&#8217;d normally need.<\/p>\n<p>Wyoming\u2019s banking commissioner, Albert Forkner, is <i>not happy<\/i> \u2014 \u201cAs part of our bank chartering process, the Division of Banking and our federal colleagues will conduct a thoughtful investigation into the lawsuit. If Kraken applies for a SPDI charter, they must meet our rigorous standards for the prevention of money laundering and sanctions violations.&#8221;<\/p>\n<p>And, key point from Forkner \u2014 &#8220;They won\u2019t do business in Wyoming unless the allegations are proven to be false.\u201d So just settling Nathan Runyon&#8217;s original wrongful termination suit won&#8217;t make Kraken&#8217;s Wyoming problems go away.<\/p>\n<p>(You can tell when a news outlet got the story from me, even if they don&#8217;t credit me \u2014 because they use <a href=\"https:\/\/docdro.id\/rbU65Yu\">the copy of the suit that I uploaded.<\/a>)<\/p>\n<p>In news from other upright and trustworthy exchanges of flawless repute, Bitfinex <a href=\"https:\/\/decrypt.co\/14830\/court-grants-bitfinex-subpoena-help-trace-lost-crypto-capital-funds\">have the subpoena<\/a> they <a href=\"https:\/\/www.coindesk.com\/bitfinex-files-for-subpoena-in-bid-to-recover-880-million-in-frozen-funds\">asked for,<\/a> to find out just what Crypto Capital Corp did with their $850 million. AUSTRAC, the Australian anti-money-laundering agency, just <a href=\"https:\/\/www.itnews.com.au\/news\/austrac-revokes-first-crypto-exchange-licences-535829\">revoked registration<\/a> for AUSCOIN ATM, MK Buy &amp; Sell and Howzat Domains. One other operator, Cryptocurrency Transaction Machines, was suspended last month.<\/p>\n<p>ICO consent orders are routine now. December 2017 ICO &#8220;Blockchain of Things&#8221; (BCOT) <a href=\"https:\/\/www.sec.gov\/news\/press-release\/2019-267\">settles with the SEC<\/a> for a $250,000 fine, returning the $13 million raised and registering as a security. Anyone claiming this isn&#8217;t sufficient &#8220;regulatory clarity&#8221; is probably a crook, or an aspiring crook.<\/p>\n<p>In Kleiman v. I flatly do not believe 20 million Americans own Bitcoin. The survey has 5000 answers, which is an <i>excellent<\/i> sample size \u2014 so how did they select people?<\/p>\n<p>It looks like they used <a href=\"https:\/\/en.wikipedia.org\/wiki\/Google_Surveys\">Google Surveys<\/a> \u2014 which works by publishers putting up surveys instead of using a paywall. This also means no normalisation of the sample, no allowance for prospective participants refusing the survey, and no correction for the profile of the sort of publisher that uses Google Surveys.<\/p>\n<p>Most people would look at a result like &#8220;20 million Americans own Bitcoin&#8221; and think for a bit about how they could have got it wrong \u2014 but not these guys. I wonder what a survey would look like that wasn&#8217;t done on the cheap by a crypto advocacy site.
