{"id":15035,"date":"2019-11-19T21:24:38","date_gmt":"2019-11-19T21:24:38","guid":{"rendered":"https:\/\/davidgerard.co.uk\/blockchain\/?p=15035"},"modified":"2020-02-28T07:57:59","modified_gmt":"2020-02-28T07:57:59","slug":"einstein-exchange-all-the-moneys-gone","status":"publish","type":"post","link":"https:\/\/davidgerard.co.uk\/blockchain\/2019\/11\/19\/einstein-exchange-all-the-moneys-gone\/","title":{"rendered":"Canada&#8217;s Einstein Exchange shuts down \u2014 and all the money&#8217;s gone"},"content":{"rendered":"<p>Yet another Canadian crypto exchange goes down \u2014 this time, the Einstein exchange in Vancouver, British Columbia, Canada, which was <a href=\"https:\/\/www.bcsc.bc.ca\/News\/News_Releases\/2019\/68_BCSC_acts_to_protect_customers_of_Einstein_Exchange_crypto-asset_trading_platform\/\">shut down by the British Columbia Securities Commission<\/a> (BCSC) on 1 November.<\/p>\n<p>Yesterday, 18 November, the news came out that there&#8217;s nothing left at all \u2014 the money and cryptos are gone.<\/p>\n<h3>The BCSC investigates<\/h3>\n<p>Here&#8217;s an <a href=\"https:\/\/docs.grantthornton.ca\/document-folder\/viewer\/docul8LWsxcWho7J\/298293881135748939?_ga=2.145004913.477358070.1572756661-1392387396.1572756661\">affidavit from Sammy Wu<\/a> of the BCSC \u2014 asking that the Einstein companies be put into receivership.<\/p>\n<p>The BCSC had been investigating Einstein since May 2019 \u2014 after multiple complaints from customers who couldn&#8217;t access their funds, going back to <a href=\"https:\/\/vancouversun.com\/business\/local-business\/bitcoin\">January 2018.<\/a><\/p>\n<p>One Einstein user, Reddit user LezzBeFriendz, was even told on 15 October to <a href=\"https:\/\/www.thedailybeast.com\/cryptocurrency-bank-einstein-exchange-vanished-leaving-customers-in-a-dollar16m-hole\">stop emailing for their money,<\/a> or Einstein would close their account:<\/p>\n<blockquote><p>As you have been told several times by several of my team members, by constantly emailing in you are further slowing down our processing times and causing further delays in your withdrawals.<\/p><\/blockquote>\n<p>Einstein&#8217;s problem was that it didn&#8217;t have all the customer funds it claimed to. Withdrawals were processed from the pool of crypto and fiat deposits \u2014 Einstein could only process withdrawals if there were enough deposits on hand. And &#8230; Einstein was deficient in both fiat and cryptos.<\/p>\n<p>On 9 October, the BCSC demanded Einstein supply financial information, fiat and crypto balances by 30 October.<\/p>\n<p>Einstein told the BCSC that it had been trying to sell itself to a US company, but the deal had fallen through \u2014 so they had planned to shut down in 30 to 60 days. Einstein claimed to have sufficient crypto on hand to satisfy withdrawal requests.<\/p>\n<p>This is unlikely. BCSC had looked over Einstein&#8217;s books in September \u2014 and worked out they had CAD$16\u00a0million in outstanding liabilities to customers.<\/p>\n<p>There had been rumours for <a href=\"https:\/\/www.reddit.com\/r\/BitcoinCA\/comments\/c49ak6\/will_einstein_exchange_be_the_next_canadian_exit\/\">much of 2019<\/a> that Einstein was going to cut and run. Customers and companies had started <a href=\"https:\/\/www.cbc.ca\/news\/canada\/british-columbia\/einstein-cryptocurrency-bitcoin-complaints-1.5347104\">filing suits<\/a> to get their money back.<\/p>\n<p>On 30 October, Reddit user 11coast posted a <a href=\"https:\/\/www.thedailybeast.com\/cryptocurrency-bank-einstein-exchange-vanished-leaving-customers-in-a-dollar16m-hole\">notice stuck to the door<\/a> of Einstein&#8217;s closed office: &#8220;Please send us an Email to support@einstein.exchange with the subject line <b>&#8216;APPOINTMENT&#8217;<\/b> to set up a time to meet with one of our support agents.&#8221; The notice had apparently been there for at least two weeks.<\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2019\/11\/19\/einstein-exchange-all-the-moneys-gone\/einstein-exchange-1-nov\/\" rel=\"attachment wp-att-15036\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-15036\" src=\"https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2019\/11\/einstein-exchange-1-nov.jpg\" alt=\"\" width=\"500\" height=\"600\" srcset=\"https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2019\/11\/einstein-exchange-1-nov.jpg 1000w, https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2019\/11\/einstein-exchange-1-nov-250x300.jpg 250w, https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2019\/11\/einstein-exchange-1-nov-853x1024.jpg 853w, https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2019\/11\/einstein-exchange-1-nov-768x922.jpg 768w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<h3>Shut down<\/h3>\n<p>On 31 October, BCSC asked Einstein&#8217;s lawyers to tell them by the next day where fiat and crypto balances were kept. &#8220;Two hours later, Einstein counsel notified me that they no longer represent Einstein.&#8221;<\/p>\n<p>On 1 November, Wu visited the Einstein offices \u2014 &#8220;the elevator is locked for all floors. I called Gokturk&#8217;s number listed on the website and the recording said all their agents are not available.&#8221;<\/p>\n<p>Michael Gokturk of Einstein told the receivers, <a href=\"https:\/\/www.grantthornton.ca\/service\/advisory\/creditor-updates\/#Einstein-Exchange-Inc\">Grant Thornton,<\/a> that he thought Einstein owed customers CAD$8 million to $10 million \u2014 not the $16\u00a0million the BCSC had worked out.<\/p>\n<p>Gokturk attributed the losses to frauds with credit cards and bank drafts. He said that the majority of the loss was in cryptos.<\/p>\n<p>What happened to the cryptos? Einstein had been keeping keys in hardware wallets \u2014 but it had also been using other crypto exchanges for &#8220;storage.&#8221; And totally not for day trading, no no.<\/p>\n<p>Grant Thornton was <a href=\"https:\/\/docs.grantthornton.ca\/document-folder\/viewer\/docul8LWsxcWho7J\/208097342448482287\">appointed as interim receiver<\/a> on 1 November \u2014 but after an <a href=\"https:\/\/docs.grantthornton.ca\/document-folder\/viewer\/docul8LWsxcWho7J\/102442047215004804\">interim report<\/a> on 14 November, they applied to be <a href=\"https:\/\/docs.grantthornton.ca\/document-folder\/viewer\/docul8LWsxcWho7J\/208097342448482287\">discharged as receiver<\/a> on 18 November.<\/p>\n<p>Grant Thornton contacted various banks in Canada and the US. Summary: all the money&#8217;s gone.<\/p>\n<p>&#8220;The Interim Receiver does not believe that the Einstein Group has any assets of substantial value&#8221; \u2014 <i>i.e.<\/i>, not enough to pay the receiver \u2014 CAD$30,000 in cash, $15,000 in crypto, some computers, mining rigs, furniture &#8230; and three Bitcoin ATMs.<\/p>\n<h3>What happens next?<\/h3>\n<p>The BCSC has control of the empty shell of the company \u2014 and will likely continue investigations into just what happened.<\/p>\n<p>It&#8217;s not clear what happened to all the money \u2014 if Gokturk was even more crooked than is usual and acceptable for the crypto space, if he was just incompetent &#8230; or if he foolishly thought that one more day trade could make up the gap in funds.<\/p>\n<p>(HT <a href=\"https:\/\/twitter.com\/evanmthomas\/status\/1191500963443617793\">Evan Thomas.<\/a>)<\/p>\n<p><strong>Addendum from Evan:<\/strong><\/p>\n<p>&#8220;One point of clarification \u2014 BCSC does not have control of the shell. The receiver is discharged and has to return all of Einstein\u2019s property.<\/p>\n<p>&#8220;The exception is the cash. Grant Thornton was directed to hold the cash and notify agencies responsible for employment and tax matters. Those agencies may have a claim on the cash.
