The suit \u2014 95 pages, but a fairly straightforward read that&#8217;s well worth your time \u2014 includes a history of Tether&#8217;s manipulations that is basically what people like me have been shouting from the rooftops for the past couple of years. It also draws heavily on material from the New York Attorney General&#8217;s investigation into Tether.<\/p>\n<p>Legally, Preston Byrne thinks <a href=\"https:\/\/www.theblockcrypto.com\/post\/42528\/fear-and-loathing-on-the-blockchain-liebowitz-et-al-v-ifinex-et-al\">there&#8217;s enough here not to be thrown out immediately<\/a> \u2014 &#8220;From my review of the pleadings, it seems to me that the plaintiffs&#8217; claims are backed by a sufficient factual basis that they will survive a 12(b)(6) motion to dismiss&#8221; \u2014 and it&#8217;s likely to proceed to discovery. The laywers are Roche Freedman LLP, who recently <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2019\/08\/28\/wright-loses-big-to-kleiman-judge-rules-kleiman-estate-owns-half-the-satoshi-stash\/\">beat Craig Wright like a gong.<\/a> Here&#8217;s the <a href=\"https:\/\/www.courtlistener.com\/docket\/16298999\/leibowitz-v-ifinex-inc\/\">docket.<\/a><\/p>\n<p>CZ from Binance told people they could <a href=\"https:\/\/twitter.com\/CasPiancey\/status\/1182311933803778050\">buy cryptos using Alipay.<\/a> Alipay tweeted that <a href=\"https:\/\/www.pymnts.com\/cryptocurrency\/2019\/alipay-bans-crypto-transactions\/\">this will get you shut down immediately.<\/a><\/p>\n<p>Though it appears that &#8220;some large Asian exchanges (won\u2019t be specific) have <a href=\"https:\/\/www.crowdfundinsider.com\/2019\/10\/152721-alipay-says-its-not-servicing-crypto-trades-but-is-it\/\">dedicated unfreezing teams.<\/a>&#8221; CZ responded &#8220;somethings are better left unsaid. Recommend no more news like these, for the sake of the people, our industry (and your business)&#8221; \u2014 which conspicuously <a href=\"https:\/\/twitter.com\/karbonbased\/status\/1182394004366909447\">doesn&#8217;t in any way deny<\/a> that this happens.<\/p>\n<p>Jennifer Robertson, the widow of QuadrigaCX&#8217;s allegedly-dead founder Gerry Cotten, wiill <a href=\"https:\/\/www.coindesk.com\/quadrigacx-founders-widow-will-cough-up-9-million-to-repay-users\">cough up $9 million<\/a> for the pitifully small pool of money to return to investors. The US Department of Justice, working with Korean Authorities, has <a href=\"https:\/\/www.justice.gov\/opa\/pr\/south-korean-national-and-hundreds-others-charged-worldwide-takedown-largest-darknet-child\">busted a darknet child porn site<\/a> that used Bitcoin. <a href=\"https:\/\/blog.chainalysis.com\/reports\/chainalysis-doj-welcome-to-video-shutdown\">Chainalysis<\/a> did a lot of the heavy lifting.<\/p>\n<p>CFTC Chairman Heath Tarber said on stage that he thinks ether, the currency of the Ethereum blockchain, <a href=\"https:\/\/finance.yahoo.com\/news\/cftc-says-cryptocurrency-ether-is-a-commodity-and-is-open-to-ether-derivatives-133455545.html\">is a commodity<\/a>\u00a0\u2014 which concurs with the <a href=\"https:\/\/finance.yahoo.com\/news\/sec-announces-ether-not-security-162658147.html\">SEC&#8217;s William Hinman<\/a> last year. Preston Byrne <a href=\"https:\/\/prestonbyrne.com\/2019\/10\/10\/if-ethereum-were-launched-today-it-would-be-a-security\/\">suggests<\/a> you don&#8217;t try an Ethereum-like launch in 2019, though \u2014 it&#8217;s very unlikely to slide past a second time.<\/p>\n<p>The SEC has rejected Bitwise&#8217;s latest proposal for a Bitcoin exchange-traded fund (ETF). The <a href=\"https:\/\/www.sec.gov\/rules\/sro\/nysearca\/2019\/34-87267.pdf\">rejection letter<\/a> is 112 pages long, and it&#8217;s a most enjoyable read \u2014 a searing indictment of Bitcoin&#8217;s <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2017\/12\/17\/why-you-cant-cash-out-pt-1-why-bitcoins-price-is-largely-fictional\/\">pathologically<\/a> <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2019\/05\/18\/number-go-down-the-single-trade-that-crashed-bitcoin\/\">terrible<\/a> market structure.<\/p>\n<p>The IRS has released <a href=\"https:\/\/www.irs.gov\/individuals\/international-taxpayers\/frequently-asked-questions-on-virtual-currency-transactions\">tax guidance on cryptocurrency forks and airdrops<\/a>\u00a0\u2014 which is fairly clear if all your crypto is on an exchange, and not in any way clear if you hold it yourself. Does the <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2017\/09\/03\/the-bitcoin-versus-bitcoin-cash-split-what-it-means-and-what-you-should-do\/\">release of Bitcoin Cash<\/a> mean you need to account for it on your 2017 return? Does the release of <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2017\/11\/20\/there-can-only-ever-be-21-million-forks-of-bitcoin-a-survey-so-far\/\">Bitcoin Super Diamond Gold Notascamcoin Plus<\/a> mean you need to account for it on your 2017 return? I&#8217;ll edit out the name, because you&#8217;ve read too many of this book too. The reviewer recommends <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/book\/\">my book<\/a> and David Golumbia&#8217;s book (<a href=\"http:\/\/amzn.to\/2ypHz1R\">US<\/a>, <a href=\"http:\/\/amzn.to\/2z9aQuM\">UK<\/a>) instead:<\/p>\n<blockquote><p>Whether or not blockchain is in fact &#8220;the next everything&#8221; is probably best left to our future robotic overlords. __&#8217;s <i>__<\/i>, the book attached to this philosophically vacuous title, is \u2014 to this human reader, at least \u2014 a dreary casserole of logical fallacies, outlandish claims, and unsummarizable discourse. Equal parts techno-solutionist propaganda piece, indoctrination gospel for the next big tech revolution, and self-help pamphlet for data survival after the extinction event, <i>__<\/i> comes leveraged in an untestable future tense, loaded with aspirational bullet-pointery, modal verbs (<i>could, should, would, might<\/i>), and abundant dead space padding out every third page. It reads like <i>The Onion<\/i> sending-up a tech influencer drunk on memes, Crypto, and cyberlibertarianism, served with a chaser of Death-by-PowerPoint.<\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">A favorite example is the Honduras land titles-on-the-blockchain. This fantasy became cemented as a case study in numerous articles and books, but it was only ever a Factom press release.
