{"id":14745,"date":"2019-10-04T23:42:57","date_gmt":"2019-10-04T23:42:57","guid":{"rendered":"https:\/\/davidgerard.co.uk\/blockchain\/?p=14745"},"modified":"2019-10-05T08:39:55","modified_gmt":"2019-10-05T08:39:55","slug":"news-eos-settles-with-sec-paypal-dumps-facebooks-libra-digitised-gold-coinbase-triples-fees-bitcoin-foundation-is-dead","status":"publish","type":"post","link":"https:\/\/davidgerard.co.uk\/blockchain\/2019\/10\/04\/news-eos-settles-with-sec-paypal-dumps-facebooks-libra-digitised-gold-coinbase-triples-fees-bitcoin-foundation-is-dead\/","title":{"rendered":"News: EOS settles with SEC, PayPal dumps Libra, digitised gold, Coinbase triples fees, Bitcoin Foundation is dead"},"content":{"rendered":"<p>EOS, in the form of Block.One, has <a href=\"https:\/\/www.sec.gov\/news\/press-release\/2019-202\">settled with the Securities and Exchange Commission<\/a> over its 2017 ICO being an unregistered securities offering \u2014 an ICO that was so hilariously terrible it rated <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/icos-magic-beans-and-bubble-machines\/\">particular mention<\/a> in <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/book\/\"><i>Attack of the 50 Foot Blockchain<\/i><\/a>. Block.One has paid a fine of $24 million.<\/p>\n<p>The crypto world has risen up as one and gone <a href=\"https:\/\/decrypt.co\/9861\/block-ones-sec-settlement-over-eos-ico-is-shockingly-weak-say-critics\">&#8220;WHAT ON EARTH&#8221;<\/a> \u2014 EOS claimed at the time to have taken in <i>four billion dollars<\/i> in ether, and getting fined 0.6% of that seems like an <em>amazing<\/em> deal.<\/p>\n<p>The <a href=\"https:\/\/www.sec.gov\/litigation\/admin\/2019\/33-10714.pdf\">order<\/a> is oddly different to other SEC administrative orders over ICOs \u2014 it&#8217;s only seven pages, and there&#8217;s no section outlining the SEC&#8217;s legal reasoning.<\/p>\n<p>Some have suggested that the fine was so small, relatively speaking, because EOS didn&#8217;t take in $4 billion at all \u2014 but instead, cycled the received Ether back through the system to make the eventual number look bigger and bag tokens for themselves. This is a trick many ICOs tried. But there&#8217;s no smoking-gun evidence I know of that EOS did this.<\/p>\n<p>Stephen Palley posts a <a href=\"https:\/\/www.theblockcrypto.com\/post\/41632\/what-the-block-one-sec-settlement-in-the-eos-ico-sale-means-and-doesnt\">considered opinion<\/a> \u2014 &#8220;I\u2019d heard whispers, off the record and unsubstantiated, of subpoenas being issued over the summer, which means that this was a formal investigation and also means that in SEC investigation time, the case settled relatively quickly, within about a year.&#8221; Block.one tried to block US investors by IP, but some got through, and there was that advertising billboard in Times Square.<\/p>\n<p>Palley cautions that this is not open season for token offerings \u2014 &#8220;the notion that this kind of settlement is a green light for unregistered securities offerings is stupid. Stupid. That\u2019s the technical word.&#8221; Don&#8217;t try this <i>now.<\/i><\/p>\n<p>&nbsp;<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The SEC on unregulated securities sales <a href=\"https:\/\/t.co\/DAf3BIBH6Q\">pic.twitter.com\/DAf3BIBH6Q<\/a><\/p>\n<p>&mdash; Cryptofungus (@crypt0fungus) <a href=\"https:\/\/twitter.com\/crypt0fungus\/status\/1179050972007587845?ref_src=twsrc%5Etfw\">October 1, 2019<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>&nbsp;<\/p>\n<p>PayPal has officially <a href=\"https:\/\/www.wsj.com\/articles\/paypal-drops-out-of-facebooks-libra-payments-network-11570218306\">dropped out of Libra.<\/a> &#8220;PayPal has made the decision to forgo further participation in the Libra Association at this time.\u201d But the company &#8220;remains supportive of Libra\u2019s mission&#8221; \u2014 so that&#8217;s nice. PayPal was the only prospective Libra Association member who <a href=\"https:\/\/www.ft.com\/content\/6af11092-e5fd-11e9-9743-db5a370481bc\">didn&#8217;t show up for a key meeting<\/a> in Washington on Thursday. PayPal is worried about the regulatory backlash \u2014 &#8220;It doesn\u2019t seem that there was a lot of pre-work done with regulators. Companies don\u2019t want that to bleed into their businesses.\u201d<\/p>\n<p>Other prospective members were getting <a href=\"https:\/\/www.ft.com\/content\/05be7adc-c4c1-11e9-a8e9-296ca66511c9\">spooked by the regulatory heat<\/a> as far back as August. <a href=\"https:\/\/www.wsj.com\/articles\/visa-mastercard-others-reconsider-involvement-in-facebook-s-libra-network-11569967023\">Visa and Mastercard<\/a> were named by the Wall Street Journal as getting iffy, and Bloomberg mentioned <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2019-10-01\/facebook-libra-payments-partners-waver-on-cryptocurrency-support\">Stripe<\/a> having qualms \u2014 they feel that Facebook &#8220;oversold&#8221; how comfortable regulators were with the project. David Marcus took to Twitter to <a href=\"https:\/\/twitter.com\/davidmarcus\/status\/1179170843693182976\">deny everything.<\/a><\/p>\n<p>Dante Disparte from Libra says there&#8217;s still 1500 organisations who&#8217;ve indicated interest in joining. Nebulous paid in fines <a href=\"https:\/\/www.theblockcrypto.com\/post\/41662\/sec-reaches-settlement-with-the-firm-behind-sia-network\">about double<\/a> what they took in in that offering.<\/p>\n<p>The FCA will be banning selling crypto margin trading to UK retail investors. The Economist starts <a href=\"https:\/\/www.economist.com\/finance-and-economics\/2019\/10\/03\/betting-on-bitcoin-prices-may-soon-be-deemed-illegal-gambling\">its piece<\/a> by blaming Bitcoin price movements on manipulation to burn the margin traders. &#8216;Cos I pointed them in that direction.<\/p>\n<p>&nbsp;<\/p>\n<p>https:\/\/twitter.com\/karbonbased\/status\/1179906676406853632<\/p>\n<p>&nbsp;<\/p>\n<p>Ohio businesses <a href=\"https:\/\/www.theblockcrypto.com\/linked\/41891\/ohio-businesses-can-no-longer-pay-taxes-in-bitcoin-as-the-method-gets-suspended\">can no longer pay taxes in bitcoin,<\/a> as the method is found not to be legal, and gets suspended. Less than ten businesses ever used it, though.<\/p>\n<p>You can tell Bitcoin is digital gold \u2014 because the crypto space attracted gold scammers. Karatbars GmbH offered a gold-backed ICO token \u2014 they&#8217;re now <a href=\"https:\/\/www.coindesk.com\/gold-backed-crypto-tokens-promoter-investigated-by-florida-regulators\">under investigation<\/a> by Florida regulators. Qu\u00e9bec regulators had <a href=\"https:\/\/lautorite.qc.ca\/en\/general-public\/media-centre\/news\/fiche-dactualites\/warning-karatbars-investment-program\/\">warned investors about Karatbars in 2014,<\/a> as have regulators in the Netherlands and Namibia.<\/p>\n<p>There&#8217;s room for fresh new gold-backed ICO operations \u2014 Dignity Gold is <a href=\"https:\/\/www.prnewswire.com\/news-releases\/dignity-gold-commences-gold-audit-procedures-300930129.html\">doing an audit,<\/a> to appease investors upset that it dropped from <a href=\"https:\/\/coinmarketcap.com\/currencies\/dignity\/\">27 cents at launch to 0.2 cent now.<\/a> But I&#8217;m sure a coin that claims it will totally be backed by $10 billion in gold when they mine it, and has a market cap of $1 million, will turn out to be entirely on the level.<\/p>\n<p>A <a href=\"https:\/\/www.bankofcanada.ca\/wp-content\/uploads\/2019\/09\/swp2019-40.pdf\">new study<\/a> from the Bank Of Canada on how much <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2018\/05\/22\/bitcoins-stupendous-power-waste-is-green-apparently-bad-excuses-for-proof-of-work\/\">more efficient<\/a> Bitcoin is than the awful legacy financial system \u2014 &#8220;Using the growth rate of 25 bitcoins, for every block and average transaction fees in 2015, we find that Bitcoin generates a large welfare loss that is about 500 times as large as in a monetary economy with 2% inflation.&#8221;<\/p>\n<p>Coinbase is dealing with the crypto winter by <a href=\"https:\/\/www.reddit.com\/r\/Bitcoin\/comments\/dcuqc7\/333_fee_increase_coming_october_7th\/\">tripling its trading fees.<\/a> It turns out dollar-based exchanges can&#8217;t really hide their trading volume problems.<\/p>\n<p>The Bitcoin Foundation is pretty much dead. You could tell that from how they&#8217;ve done nothing in the past four or five years, but they finally <a href=\"https:\/\/archive.is\/hcvrz\">stopped paying for the website<\/a> last month.
