Type hard or go home.<br \/>\n<\/small><\/p>\n<p>&nbsp;<\/p>\n<p>Craig Wright has <a href=\"https:\/\/www.coindesk.com\/judge-recommends-ruling-in-favor-of-kleiman-in-craig-wright-case\">almost certainly lost big<\/a> in the case brought against him by the estate of Dave Kleiman, demanding <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2019\/06\/15\/craig-wright-has-to-show-up-in-florida-on-28-june-or-else\/\">half of the million bitcoins<\/a> that Wright claims he mined with Kleiman as &#8220;Satoshi Nakamoto&#8221; \u2014 because Magistrate Judge Bruce Reinhart <a href=\"https:\/\/www.theblockcrypto.com\/2019\/08\/26\/federal-court-reportedly-finds-craig-wright-perjured-himself-awards-kleiman-ip-and-bitcoins\/\">doesn&#8217;t believe Wright&#8217;s testimony,<\/a> and has <a href=\"https:\/\/twitter.com\/22centurycrypto\/status\/1166081027221196805\">struck all of it out.<\/a> Wright now owes the Kleiman estate half a million bitcoins \u2014 about $5 billion in notional value.<\/p>\n<p>The order isn&#8217;t up on the <a href=\"https:\/\/www.courtlistener.com\/docket\/6309656\/kleiman-v-wright\/?page=2\">docket<\/a> as yet (<b>EDIT:<\/b> <a href=\"https:\/\/www.courtlistener.com\/recap\/gov.uscourts.flsd.521536\/gov.uscourts.flsd.521536.277.0.pdf\">here it is,<\/a> and here&#8217;s <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2019\/08\/28\/wright-loses-big-to-kleiman-judge-rules-kleiman-estate-owns-half-the-satoshi-stash\/\">my writeup of it<\/a>) \u2014 but those present in court yesterday report that Judge Reinhart recommended Kleiman&#8217;s estate be awarded 50% of bitcoins Wright held prior to 31 December 2013, as well as 50% of intellectual property that Wright supposedly developed with Kleiman prior to 31 December 2013. Wright also has to <a href=\"https:\/\/twitter.com\/KatieAnanina\/status\/1166095066873638913\">pay Kleiman&#8217;s attorney fees.<\/a><\/p>\n<p>Wright will apparently <a href=\"https:\/\/twitter.com\/22centurycrypto\/status\/1166088336420814849\"><i>not<\/i> be referred for contempt of court<\/a> charges \u2014 I expect losing $5 billion was considered a sufficient penalty. Wright will not be entitled to a jury trial. He can appeal.<\/p>\n<p>If Wright&#8217;s attorneys don&#8217;t file any convincing exceptions or objections, the order will go to District Judge Beth Bloom \u2014 who will almost certainly sign off on it.<\/p>\n<p>At that point, Wright owes $5 billion in bitcoins, that he never controlled, to the estate of the guy he didn&#8217;t develop Bitcoin with \u2014 because he wouldn&#8217;t back down on his claim to be Satoshi Nakamoto.<\/p>\n<p>The ruling says nothing about whether Wright is Satoshi \u2014 both sides have stipulated this as a fact in the case, so the judge was apparently fine to go along with it.<\/p>\n<p>What happens now isn&#8217;t clear. Wright <a href=\"https:\/\/modernconsensus.com\/cryptocurrencies\/bitcoin\/exclusive-interview-with-craig-wright-just-after-ordered-to-pay-5-billion-in-bitcoin\/\">told Modern Consensus<\/a> that he&#8217;s going to cough up the bitcoins \u2014 which could be difficult given he&#8217;s not Satoshi in the real world. We&#8217;ll need to see the order to see if Judge Reinhart specified &#8220;or their cash equivalent.&#8221;<\/p>\n<p>(I thought that Modern Consensus interview was the most gullible thing I&#8217;d seen today \u2014 but I&#8217;m now wondering about the forthcoming book <a href=\"https:\/\/www.amazon.com.au\/Behind-Mask-Wright-Battle-Bitcoin\/dp\/192571280X\/\"><i>Behind the Mask: Craig Wright and the Battle for Bitcoin<\/i><\/a> by Byron Kaye and Jeremy Wagstaff. At least they have a few months for a very quick update on events.)<\/p>\n<p>The court ordered considerable further <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2019\/07\/24\/kleiman-v-wright-international-deposition-and-discovery-requested-from-andrew-ohagan-ramona-watts-and-robert-macgregor\/\">discovery and depositions<\/a> in this case \u2014 I&#8217;m not clear on whether those will proceed. One US litigator on Twitter <a href=\"https:\/\/twitter.com\/intjr\/status\/1166089641587564544\">suggests<\/a> there&#8217;s more to come.<\/p>\n<p>This ruling won&#8217;t help in Wright&#8217;s defamation cases in the UK <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2019\/08\/14\/peter-mccormack-responds-to-craig-wrights-defamation-claim-and-its-blistering\/\">against Peter McCormack<\/a> and others \u2014 Jake Chervinsky <a href=\"https:\/\/twitter.com\/jchervinsky\/status\/1166097257009229824\">suggests<\/a> that even if it&#8217;s not a direct precedent, &#8220;if UK defamation defendants can find a way to introduce this, it&#8217;ll have some informal-but-persuasive impact on the judge&#8221;.<\/p>\n<p>I fully accept that I could be wrong in saying that Wright didn&#8217;t invent Bitcoin \u2014 in which case, I invite him to move a Satoshi bitcoin, as he has repeatedly claimed he can, and prove me wrong.<\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2019\/05\/03\/news-bitfinex-and-tether-latest-craig-wright-man-of-action-india-bans-cryptos\/craig-wright-113\/\" rel=\"attachment wp-att-13150\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-13150\" src=\"https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2019\/05\/craig-wright-113.jpg\" alt=\"\" width=\"500\" height=\"333\" srcset=\"https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2019\/05\/craig-wright-113.jpg 1140w, https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2019\/05\/craig-wright-113-300x200.jpg 300w, https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2019\/05\/craig-wright-113-768x512.jpg 768w, https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2019\/05\/craig-wright-113-1024x683.jpg 1024w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>BITCOIN IS IMMUNE TO GOVERNMENT CONFISCATION! Except if you&#8217;re in real life \u2014 \u00a3900,000 in bitcoins was seized from hacker Grant West to compensate his victims. They did HLTH as a SAFT \u2014 but the SEC says the resulting tokens would still have been securities. The SEC contacted SimplyVital \u2014 after the pre-sale but before the public sale \u2014 and the company returned all the ether and US dollars from the pre-sale. No penalty was imposed \u2014 I&#8217;m quite surprised to see a no-fine admin order this late in the ICO saga.<\/p>\n<p>Canadian alleged crypto fraudsters Lisa Angela Cheng and Kevin Patrick Hobbs of Vanbex, promoters of the FUEL ICO, asked the court for their seized luxury goods back. <a href=\"https:\/\/theprovince.com\/business\/local-business\/judge-rejects-plea-to-set-aside-order-to-preserve-luxury-assets-in-alleged-30-million-cryptocurrency-fraud\/wcm\/1c7be7ab-2560-4b22-b194-a4f46c8d2ac5\">The judge said no.<\/a><\/p>\n<p>&#8220;It\u2019s now obvious that ICOs were a massive bubble that&#8217;s unlikely to ever see a recovery&#8221; \u2014 a <a href=\"https:\/\/twitter.com\/lawmaster\/status\/1159130023963561984\">Twitter thread from Larry Cermak,<\/a> with numbers. &#8220;The median ICO return in terms of USD is -87% and constantly dropping.
