Wright, IRS on criminal investigations into crypto, regulators still hate Facebook Libra, Trump vs Libra and Bitcoin, more crypto exchange hacks"},"content":{"rendered":"<p>The New York Attorney General has dropped a new filing, with 29 exhibits attached, in their case <em>concerning<\/em> \u2014 not yet <i>against<\/i> \u2014 the iFinex companies, including Bitfinex and Tether. This <a href=\"https:\/\/iapps.courts.state.ny.us\/nyscef\/ViewDocument?docIndex=\/_PLUS_iqIuzGOBBoAaaiknE4Ag==\">&#8220;Memorandum of Law in Opposition to Respondents&#8217; Motion to Dismiss and for an Immediate Stay<\/a>&#8221; is not yet a criminal action against iFinex \u2014 it&#8217;s merely to keep the investigation open, and to get iFinex to cough up the information already subpoenaed from them.<\/p>\n<p>Mostly, the NY AG is responding in detail to iFinex&#8217;s claims that New York has no jurisdiction over them \u2014 pages 6 and 9 to 11 recount in detail all iFinex&#8217;s links to New York State. This is after iFinex&#8217;s lawyer Stuart Hoegner had represented earlier in <i>this court proceeding<\/i> that iFinex had banned New York customers as of 30 January 2017.<\/p>\n<p>For me, what nails it is just how many New York clients Tether has \u2014 including such as Michael Novogratz&#8217; Galaxy Digital, whose letter to BFXNA of 15 October 2018 is attached to the filing. Novogratz <a href=\"https:\/\/twitter.com\/novogratz\/status\/1121761199547457536\">claimed<\/a> (<a href=\"https:\/\/web.archive.org\/web\/20190709094915\/https:\/\/twitter.com\/novogratz\/status\/1121761199547457536\">archive<\/a>) on 26 April 2019 that &#8220;GLXY has zero exposure to Bitfinex or Tether&#8221; \u2014 perhaps Galaxy had sold all its tethers by then.<\/p>\n<p>Bitfinex opened a trading account with &#8220;a New York-based virtual currency trading firm&#8221; (unnamed, but it&#8217;d be Coinbase or Gemini) in January 2019. Documentation of this <i>should<\/i> have been produced by iFinex already \u2014 but wasn&#8217;t.<\/p>\n<p>Giancarlo Devasini told Bitfinex customers to send money via Crypto Capital for fast service \u2014 and, on literally the same day, was frantically contacting Crypto Capital asking why withdrawals weren&#8217;t being sent out, and warning that the Bitcoin price could drop below $1000 if Tether Inc. ran out of money.<\/p>\n<p>Also, iFinex helped New York companies set up foreign shell companies so they could trade with Bitfinex. And <i>loaned<\/i> tethers \u2014 did not sell them, but loaned them \u2014 to &#8220;at least one New York based trading firm&#8221;. In 2019.<\/p>\n<p>The facts look really pretty bad. That said, the law is not about just the facts \u2014 it&#8217;s about what the facts mean. iFinex have until 22 July to respond, and the next hearing will be 29 July \u2014 perhaps they can successfully argue that two plus two only <i>appears<\/i> to make four, when actually it makes three, or five, or six hundred and sixty-six.<\/p>\n<p>Oh, Tether <a href=\"https:\/\/decrypt.co\/7871\/number-almost-go-up-tether-inadvertently-prints-five-billion-unbacked-tethers\">accidentally printed five billion tethers<\/a> yesterday.<\/p>\n<p>By the way \u2014 Wells Fargo <a href=\"https:\/\/twitter.com\/Ask_WellsFargo\/status\/1149728891059261441\">&#8220;does not allow transactions involving cryptocurrency.&#8221;<\/a><\/p>\n<p>&nbsp;<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">A $600 fraud pump on the incorrect news that Tether had printed $5B. <a href=\"https:\/\/t.co\/pZUUQNTM9q\">pic.twitter.com\/pZUUQNTM9q<\/a><\/p>\n<p>&mdash; Bitfinex Parody (@Bitfinex2) <a href=\"https:\/\/twitter.com\/Bitfinex2\/status\/1150176397538791424?ref_src=twsrc%5Etfw\">July 13, 2019<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>&nbsp;<\/p>\n<p>Craig Wright went into court on 10 July to argue that the federal court is\u00a0 not, in fact, the proper jurisdiction for <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2019\/06\/15\/craig-wright-has-to-show-up-in-florida-on-28-june-or-else\/\">Kleiman v. Wright<\/a> \u2014 and the whole case should start over in Florida state court. Which would mean another year and a half to resolve the matter \u2014 how unfortunate! <a href=\"https:\/\/www.law360.com\/banking\/articles\/1167428\/bitcoin-inventor-wants-10b-suit-kicked-to-state-court\">Law 360<\/a> has the report (<a href=\"https:\/\/archive.is\/Q9KxC\">archive<\/a>).<\/p>\n<p>Wright <a href=\"https:\/\/www.courtlistener.com\/docket\/6309656\/kleiman-v-wright\/?page=2\">submits<\/a> supplementary claims as to the ownership of W &amp; K Info Defense Research. Ira Kleiman opposes, as Wright could have submitted this any time previously \u2014 such as in discovery or deposition, when he was supposed to: &#8220;&#8230; a desperate attempt to evade this Court\u2019s jurisdiction by manufacturing self-serving and unsupported testimony.&#8221;<\/p>\n<p>In support of this, Kleiman attaches an affidavit from his expert witness, <a href=\"https:\/\/www.courtlistener.com\/recap\/gov.uscourts.flsd.521536\/gov.uscourts.flsd.521536.242.2.pdf\">Matthew J. Edman<\/a> \u2014 &#8220;Exhibit A and Exhibit F, which appear to be emails sent from Dave Kleiman to Uyen Nguyen on December 20, 2012, are manipulations of a PDF created from an email the Defendant sent from himself to himself on or about April 16, 2014.&#8221; Edman goes through the structure of the PDFs, showing what appears to have been derived from what \u2014 and places where a hash in the metadata is the same, when you&#8217;d expect it to have changed. Facebook are still trying to brazen this out \u2014 nobody proclaiming their &#8220;humility&#8221; has any. The question session afterwards should be a <i>delight.<\/i><\/p>\n<p>Federal Reserve Chairman <a href=\"https:\/\/www.reuters.com\/article\/us-usa-fed-powell-libra\/fed-chief-calls-for-facebook-to-halt-libra-project-until-concerns-addressed-idUSKCN1U51VE\">Jerome Powell wants Facebook&#8217;s Libra halted<\/a> until regulators&#8217; concerns are addressed.<\/p>\n<p>President Donald Trump <a href=\"https:\/\/twitter.com\/realDonaldTrump\/status\/1149472284702208000\">tweeted<\/a> that Facebook will need a banking charter to do what they&#8217;re planning.<\/p>\n<p>Trump also <a href=\"https:\/\/twitter.com\/realDonaldTrump\/status\/1149472282584072192\">tweeted<\/a> that he doesn&#8217;t think much of Bitcoin, though it&#8217;s not clear what follows from this \u2014 beyond the crypto press imitating headless chickens, and Bitcoin boosters declaring this the <i>best<\/i> news for Bitcoin. Withdrawals started failing in May, and on 17 June their website, Twitter and Facebook disappeared, as did CTO Dmitry Prudnikov&#8217;s LinkedIn. Bitsane got a lot of users during the crypto bubble because it did XRP, and Coinbase didn&#8217;t at the time \u2014 CNBC&#8217;s January 2018 <a href=\"https:\/\/www.cnbc.com\/2018\/01\/02\/how-to-buy-ripple.html\">&#8220;How To Buy Ripple&#8221;<\/a> article set out how to use Bitsane.<\/p>\n<p>Japanese exchange Bitpoint was <a href=\"https:\/\/www.ft.com\/content\/c23930d4-a474-11e9-974c-ad1c6ab5efd1\">hacked on Thursday evening,<\/a> losing $32 million of cryptos from its hot wallet.
