{"id":13012,"date":"2019-04-30T22:30:45","date_gmt":"2019-04-30T22:30:45","guid":{"rendered":"https:\/\/davidgerard.co.uk\/blockchain\/?p=13012"},"modified":"2019-05-02T16:12:59","modified_gmt":"2019-05-02T16:12:59","slug":"bitfinex-tether-and-the-ny-attorney-general-everything-is-fine","status":"publish","type":"post","link":"https:\/\/davidgerard.co.uk\/blockchain\/2019\/04\/30\/bitfinex-tether-and-the-ny-attorney-general-everything-is-fine\/","title":{"rendered":"Bitfinex, Tether and the NY Attorney General: EVERYTHING IS FINE"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2018\/02\/09\/bitfinex-tether-and-bitfinexed-updates-and-summary\/gravity-lessons\/\" rel=\"attachment wp-att-4895\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/davidgerard.co.uk\/blockchain\/wp-content\/uploads\/2018\/02\/gravity-lessons.jpg\" alt=\"\" width=\"510\" height=\"340\" class=\"aligncenter size-full wp-image-4895\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>In response to the New York Attorney General&#8217;s <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2019\/04\/25\/quick-update-new-york-attorney-general-sues-bitfinex-850m-hole-in-tether-reserves\/\">ex parte order against Tether and Bitfinex<\/a> last week, general counsel Stuart Hoegner and outside counsel Zoe Phillips of Morgan Lewis have filed a thunderous pair of affidavits just today \u2014 asserting that New York has no jurisdiction, none of Bitfinex or Tether&#8217;s actions are <a href=\"https:\/\/www.scribd.com\/document\/408190969\/Zoe-Phillips-Filing-4-30\">within the ambit of the Martin Act<\/a> &#8230; and that the $2.8 billion worth of tethers are only <a href=\"https:\/\/www.scribd.com\/document\/408190972\/Stuart-Hoegner-Affidavit-4-30\">74% backed:<\/a><\/p>\n<blockquote><p><span class=\"a\">Tether has cash and cash equivalents (short term securities) on hand totaling approximately <\/span><span class=\"a\">$2.1 billion, representing approximately <span class=\"fourgen_highlight fourgen_highlight_selected\">74<\/span> percent of the current outstanding tethers.<\/span><\/p><\/blockquote>\n<p>Also, banks run fractional reserves, so Tether should totally be able to. Though they don&#8217;t want bank-style regulation, for some reason.<\/p>\n<p>&nbsp;<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Why have I wasted my whole day off reading NYSD court filings<\/p>\n<p>&mdash; guglielmo (@Ben_Munster) <a href=\"https:\/\/twitter.com\/Ben_Munster\/status\/1121775186880139264?ref_src=twsrc%5Etfw\">April 26, 2019<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>&nbsp;<\/p>\n<p>Bitfinex&#8217;s Reddit representative garbis_bitfinex posted an official response to the NY AG filings &#8230; but <a href=\"https:\/\/www.reddit.com\/r\/bitfinex\/comments\/bhf9jj\/with_regards_to_the_recent_allegations\/eluo3my\/?context=8&amp;depth=9\">hadn&#8217;t read them himself<\/a> before doing so.<\/p>\n<p>And the moderator of Reddit \/r\/bitfinex announced an <a href=\"https:\/\/www.reddit.com\/r\/bitfinex\/comments\/bhbmp6\/a_new_ama_is_starting_next_week_on_reddit\/\">&#8220;Ask Me Anything&#8221;<\/a> \u2014 three hours before the NY AG&#8217;s order was announced. There were a number of <em>pointed questions.<\/em> The AMA will apparently happen on Friday 3 May, but this one is only for questions about the <a href=\"https:\/\/www.reddit.com\/r\/bitfinex\/comments\/bhbmp6\/a_new_ama_is_starting_next_week_on_reddit\/elyu4pk\/\">Bitfinex programming API.<\/a><\/p>\n<p>Remember how Bitfinex got hacked in August 2016, and 120,000 bitcoins were stolen? (See <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/table-of-contents\/\">chapter 8<\/a> of\u00a0<a href=\"https:\/\/davidgerard.co.uk\/blockchain\/book\/\"><em>Attack of the 50 Foot Blockchain.<\/em><\/a>) Just a few hours <em>before<\/em> the NY AG&#8217;s order was announced, on 25 April, <a href=\"https:\/\/coinspice.io\/news\/bitfinex-sued-by-ny-attorney-general-300-hacked-bitcoin-addresses-moved\/\">$1.6 million worth of coins from the hack<\/a> moved for the first time.<\/p>\n<p>There are rumours of a plan to plug the hole in Bitfinex\/Tether&#8217;s accounts after $850 million was <a href=\"https:\/\/www.bitfinex.com\/posts\/356\">&#8220;seized and safeguarded&#8221;<\/a> by <a href=\"https:\/\/www.financemagnates.com\/cryptocurrency\/news\/bitfinex-mixed-colombian-cocaine-polish-media-reports\/\">Polish,<\/a> Portuguese, US and UK authorities \u2014 Bitfinex is thinking of running a <a href=\"https:\/\/decryptmedia.com\/6806\/bitfinex-ieo-rumors\">$1 billion exchange token offering!<\/a> I would say &#8220;you&#8217;d need to be nuts to spend a single penny on such a thing,&#8221; but that would be assuming the slightest rationality of the crypto market.<\/p>\n<p>And the latest, just in \u2014 the US Attorney General has just <a href=\"https:\/\/www.justice.gov\/usao-sdny\/pr\/arizona-man-and-israeli-woman-charged-connection-providing-shadow-banking-services\">charged two individuals,<\/a> Reginald Fowler and Ravid Yosef, with &#8220;bank fraud and operating an unlicensed money transmitting business&#8221; \u2014 specifically, supplying &#8220;shadow banking&#8221; services to various crypto exchanges, by lying to banks about what they were opening accounts for:<\/p>\n<blockquote><p>Hundreds of millions of dollars flowed through the Crypto Companies\u2019 accounts from banks located across the globe.<\/p><\/blockquote>\n<p>Fowler and Yosef operated as Global Trading Solutions \u2014 which <a href=\"https:\/\/twitter.com\/lawmaster\/status\/1048515520482484224?lang=en\">Bitfinex operated through<\/a> for a time last October. It turns out that <a href=\"https:\/\/twitter.com\/RayRedacted\/status\/1122155703693660163\">commingling company and client funds<\/a> during your less-solvent moments is horrifyingly illegal.
