The SEC has issued a <a href=\"https:\/\/www.sec.gov\/divisions\/corpfin\/cf-noaction\/2019\/turnkey-jet-040219-2a1.htm\">no-action letter to TurnKey Jet,<\/a> whose token is basically prepayment for on-demand charter flights, but on a blockchain \u2014 the network and app already existed in fully functional form, the tokens could be used immediately, they can&#8217;t be transferred outside TKJ wallets, the price is fixed at USD$1 per token, TurnKey Jet will only repurchase the tokens for less than the customer paid, and they were not at any stage marketed as an investment opportunity. It&#8217;s that easy!<\/p>\n<p>The SEC&#8217;s <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2017\/12\/12\/news-2017-in-buttcoin-icos-parity-bailout-nicehash-post-mortem-cashing-in-bitcoins-wikipedia\/\">December 2017 administrative order against the Munchee ICO<\/a> has been <a href=\"https:\/\/www.theblockcrypto.com\/2019\/04\/02\/ico-token-didnt-entitle-buyers-to-profits-u-s-judge-says-it-sounds-like-a-security-anyway\/\">used by a court as guidance in a civil case,<\/a> where burnt investors are claiming ATBCoin was a security. <a href=\"https:\/\/twitter.com\/stephendpalley\/status\/1113045776962383877\">Palley:<\/a> &#8220;So this Article I consent order just became Article III case law. Which is more than a little interesting.&#8221; Administrative orders aren&#8217;t precedent &#8230; except when they turn out to be.<\/p>\n<p>&nbsp;<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Remember all those arguments about the term &quot;sufficiently decentralized&quot;?<\/p>\n<p>It doesn&#39;t show up even once in the SEC&#39;s DLT Framework. Gambling, condos, and &#8230; a Lamborghini! Vancouver police have <a href=\"https:\/\/www.coindesk.com\/police-freeze-bank-accounts-seize-luxury-cars-in-probe-of-22-million-ico-promoter-vanbex\">frozen their assets and seized the cars.<\/a> Vanbex have issued a statement <a href=\"https:\/\/www.cryptopolitan.com\/vanbex-responds-to-civil-claim-and-media\/\">denying everything.<\/a> CEO Kevin Hobbs has past convictions for drug trafficking and money laundering, and founder Lisa Cheng was involved in the early days of Mastercoin (now Omni) and Realcoin (now Tether). Here&#8217;s <a href=\"https:\/\/blockleaders.io\/2019\/03\/29\/the-disruptive-power-of-lisa-cheng\/\">a profile of Cheng in Blockleaders<\/a> (<a href=\"https:\/\/archive.is\/ZnVB7\">archive<\/a>), which ran just a few days before the news broke. &#8220;The disruptive power of Lisa Cheng,&#8221; indeed.<\/p>\n<p>The standard scammy ICO with fake team photos is likely to be <a href=\"https:\/\/decryptmedia.com\/6331\/kyc-ico-mycrypto\">super-bad with user data<\/a> \u2014 <em>e.g.<\/em>, just uploading the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Know_your_customer\">Know-Your-Customer<\/a> data as <a href=\"https:\/\/en.support.wordpress.com\/images\/adding-images-to-posts-or-pages\/\">publicly accessible<\/a> WordPress image files.<\/p>\n<p>Missoula County, Montana proposes to require that new crypto mining projects offset their energy use by <a href=\"https:\/\/www.wired.com\/story\/montana-county-crimp-bitcoin-save-the-earth\">funding or building new renewable projects.<\/a> Trivially evadable, but may be worth setting as an expectation.<\/p>\n<p>Grant County Public Utility District in Washington is allowed to <a href=\"https:\/\/medium.com\/crypto-caselaw-minute\/crypto-caselaw-minute-30-4-4-2019-c0d9db7f0482\">charge crypto miners a 400% rate premium.<\/a> This is necessary because it turns out <em>in practice<\/em> that crypto miners don&#8217;t in fact <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2018\/05\/22\/bitcoins-stupendous-power-waste-is-green-apparently-bad-excuses-for-proof-of-work\/\">incentivise green energy,<\/a> but swoop in, <a href=\"https:\/\/www.politico.com\/magazine\/story\/2018\/03\/09\/bitcoin-mining-energy-prices-smalltown-feature-217230\">max out local hydro power capacity,<\/a> then swoop out.<\/p>\n<p>The most reprehensible idea I&#8217;ve heard in crypto in the past month \u2014 <a href=\"https:\/\/www.bbc.co.uk\/news\/technology-47786257\">crypto for old age care homes.<\/a> The Carlauren Coin &#8220;exchange&#8221; does no Know-Your-Customer. It claims you can sell your \u00a370 coin on the market for \u00a3189 right there \u2014 but, of course, there are no buyers as yet.
