It also turns out that calling your offering a SAFT isn&#8217;t magic. &#8220;The SEC has gotten dozens of ICOs to refund buyers and pay a fine, simply by reaching out and asking questions.&#8221; I&#8217;m just surprised it took them this long.<\/p>\n<p>&nbsp;<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The undercover FBI agent who investigated 1broker bought his first unregistered security-based swap on March 30, 2016. The government didn&#39;t take action until two and a half years later.<\/p>\n<p>The majority of ICOs (unregistered securities?) were issued in 2H 2017.<\/p>\n<p>Buckle up, folks.<\/p>\n<p>&mdash; Jake Chervinsky (@jchervinsky) <a href=\"https:\/\/twitter.com\/jchervinsky\/status\/1046784802475692032?ref_src=twsrc%5Etfw\">October 1, 2018<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>&nbsp;<\/p>\n<p>KodakCoin latest: they finally closed the ICO on 30 September. Meanwhile, it appears that Ryde GmbH put up its software\u00a0\u2014 the basis for the exciting new KodakOne system\u00a0\u2014 as <a href=\"https:\/\/www.sec.gov\/Archives\/edgar\/data\/1515139\/000149315218012827\/ex10-4.htm\">security<\/a> for a <a href=\"https:\/\/www.sec.gov\/Archives\/edgar\/data\/1515139\/000149315218012827\/form8-k.htm\">loan<\/a> from ICOx Innovations. <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2018\/09\/11\/news-the-sec-swings-into-action-marshall-islands-sov-papua-new-guinea-new-stablecoins-indian-crypto-legality-r3-and-ripple-settle-star-xu-of-okex-detained-kodakcoin\/\">WENN Media split<\/a> from Ryde GmbH, and <a href=\"http:\/\/www.thomas-pr.com\/copytrack\/copytrackwennrelease.html\">signed up with<\/a> KodakOne&#8217;s competitor, Copytrack\u00a0\u2014 who ran an ICO in January, and whose white paper proposal was very similar to <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2018\/08\/19\/the-kodakcoin-kodakone-confidential-offering-memorandum-21-may-2018\/\">KodakCoin&#8217;s.<\/a> Copytrack are now <a href=\"https:\/\/www.wired.de\/article\/strafanzeige-nach-millionen-ico-aerger-fuer-chef-des-berliner-start-ups-copytrack-concensum-blockchain\">being sued over <em>their<\/em> ICO<\/a>\u00a0\u2014 a lot of stuff Copytrack claimed doesn&#8217;t &#8230; appear to exist. And by the way, here&#8217;s the <a href=\"https:\/\/www.sec.gov\/Archives\/edgar\/data\/1728003\/000172800318000001\/xslFormDX01\/primary_doc.xml\">SEC form D<\/a> for the January 2018 second round of the KodakCoin ICO\u00a0\u2014 the one that aimed for $6,750,000 and netted $880,000.<\/p>\n<p>Unforeseen ICO hazards \u2014 someone bought 530 Copytrack tokens (~CDN$780). Copytrack mistakenly sent 530 ETH (~CDN$495,000). They asked the recipient for the ether back \u2014 but he said he&#8217;d been hacked, so sorry, too bad. Copytrack sued him for the return of the funds &#8230; but <a href=\"https:\/\/www.canlii.org\/en\/bc\/bcsc\/doc\/2018\/2018bcsc1709\/2018bcsc1709.html\">the recipient has since died.<\/a> Neither party contests the facts of the case, so the Supreme Court of British Columbia has ordered those <em>particular<\/em> ETH be returned to Copytrack \u2014 not any old 530 ETH, not the CDN$495,000 cash value. It&#8217;s not clear how this will be resolved.<\/p>\n<p><a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2018\/03\/24\/woolf-university-college-courses-literally-on-the-ethereum-blockchain\/\">Woolf University<\/a> \u2014 the university plannng literally to run on the blockchain \u2014 is <a href=\"https:\/\/abcnews.go.com\/International\/worlds-1st-blockchain-university-begin-teaching-2019\/story?id=58226066\">still on the publicity trail.<\/a> No, nothing about this makes any more sense than it did previously.<\/p>\n<p>Including transactions is too slow, let&#8217;s just mine empty blocks \u2014 <a href=\"https:\/\/decryptmedia.com\/2018\/10\/02\/spy-mining-hits-ethereum\/\">now on Ethereum!<\/a><\/p>\n<p>SpankChain <a href=\"https:\/\/cointelegraph.com\/news\/hackers-breach-smart-contract-on-ethereum-based-adult-entertainment-platform-spankchain\">just lost $38,000 in Ether<\/a> to a Solidity re-entrancy bug very like the one that took out <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/the-dao\/\">The DAO.<\/a><\/p>\n<p>FT Alphaville: <a href=\"https:\/\/ftalphaville.ft.com\/2018\/10\/03\/1538556169000\/Coinbase-wants-to-be--too-big-to-fail---lol\/\">Coinbase wants to be \u201ctoo big to fail\u201d, lol<\/a> \u2014 those times when it&#8217;s 100% appropriate for an august financial journal to use &#8220;lol&#8221; in a headline.<\/p>\n<p>I don&#8217;t want to scare you \u2014 but crypto exchange volume <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2018-09-27\/crypto-s-open-secret-its-multibillion-dollar-volume-is-suspect\">is frequently fake.<\/a> You can even buy <a href=\"https:\/\/twitter.com\/bccponzi\/status\/1047819729732292608\">wash trading services.<\/a> And OTC and &#8220;decentralised&#8221; trading is <a href=\"https:\/\/medium.com\/@cryptowhistle\/an-inconvenient-truth-decentralized-otc-style-crypto-platforms-are-used-for-market-manipulation-fa03a312090d\">a lot of the manipulation.<\/a><\/p>\n<p>Wall Street Journal, October 2018: <a href=\"https:\/\/www.wsj.com\/articles\/the-bots-manipulating-bitcoins-price-1538481600\">&#8220;Bots Are Manipulating Price of Bitcoin in \u2018Wild West of Crypto\u2019.&#8221;<\/a> Bitfinex&#8217;ed, August 2017: <a href=\"https:\/\/hackernoon.com\/meet-spoofy-how-a-single-entity-dominates-the-price-of-bitcoin-39c711d28eb4\">&#8220;Meet &#8216;Spoofy&#8217;.&#8221;<\/a><\/p>\n<p>Why you can&#8217;t cash out, QuadrigaCX edition: <a href=\"https:\/\/www.theglobeandmail.com\/business\/article-vancouver-crypto-exchange-cibc-clash-over-frozen-accounts\/\">$28m Canadian is frozen<\/a> (<a href=\"http:\/\/archive.is\/ehMvX\">archive<\/a>) at CIBC, the bank of Quadriga&#8217;s payment processor \u2014 because they literally couldn&#8217;t determine whose money it was. &#8220;In a factum filed with the Ontario Superior Court of Justice, the bank says it froze the accounts after it was unable to determine who owns the funds.&#8221; Quadriga is\u00a0<em>shocked, shocked<\/em> at such assertions \u2014 &#8220;This court should not succumb to the bank\u2019s unsubstantiated and highly offensive speculation that there must be shady dealings afoot because Quadriga\u2019s business is a trading platform for individuals trading in cryptocurrencies.&#8221; When I wrote up the KYC\/AML problems with <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2017\/12\/23\/why-you-cant-cash-out-pt-2-bitcoin-and-know-your-customer-anti-money-laundering-laws-kyc-aml\/\">getting your money out<\/a> in December, some commenters told me how Quadriga was 100% reliable &#8230;<\/p>\n<p>Meanwhile, a <a href=\"https:\/\/www.ft.com\/content\/1a67f6b2-bbf7-11e8-94b2-17176fbf93f5\">global standard for cryptocurrency anti-money laundering<\/a> is shortly to be agreed (<a href=\"https:\/\/archive.is\/BwhkW\">archive<\/a>).<\/p>\n<p><a href=\"https:\/\/yobit.net\/en\/pump\/timer\/\">Every 24 hours,<\/a> the YoBit crypto exchange will pick a random minor altcoin and pump it by <a href=\"https:\/\/twitter.com\/YobitExchange\/status\/1050035464609124352\">buying 10 BTC worth,<\/a> in ten transactions. (<a href=\"https:\/\/web.archive.org\/web\/20181010150343\/https:\/\/twitter.com\/YobitExchange\/status\/1050035464609124352\">Archive<\/a>, <a href=\"https:\/\/archive.is\/mAaBo\">archive<\/a>.) YoBit previously had problems with the authorities in <a href=\"https:\/\/cointelegraph.com\/news\/cryptocurrency-exchange-yobit-investigated-in-russia-on-fraud-claims\">Russia<\/a>, <a href=\"http:\/\/web.archive.org\/web\/20170307102033\/http:\/\/forbes.net.ua\/news\/1428269-protiv-yobit-otkryty-ugolovnye-dela-za-moshennichestvo\">Ukraine and Indonesia<\/a> (<a href=\"https:\/\/translate.google.com\/translate?sl=auto&amp;tl=en&amp;js=y&amp;prev=_t&amp;hl=en&amp;ie=UTF-8&amp;u=http%3A%2F%2Fweb.archive.org%2Fweb%2F20170307102033%2Fhttp%3A%2F%2Fforbes.net.ua%2Fnews%2F1428269-protiv-yobit-otkryty-ugolovnye-dela-za-moshennichestvo&amp;edit-text=\">translation<\/a>), because they keep trading against their own customers. But I&#8217;m sure you can trust them.<\/p>\n<p>Binance previously told new altcoins who wanted to be listed on the exchange to pay <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/2018\/08\/11\/news-3b-bitcoin-scam-bitconnect-tezos-ruling-bad-ico-news-bitfi-augur-voatz\/\">a couple of million dollars<\/a> for the privilege. This has proven sufficiently embarrassing that Binance will now be <a href=\"https:\/\/support.binance.com\/hc\/en-us\/articles\/360017664751\">making all listing fees public, and donating 100% of the fees to charity<\/a>\u00a0\u2014 specifically, Binance&#8217;s own <a href=\"https:\/\/www.binance.charity\/\">Blockchain Charity Foundation,<\/a> which will focus on &#8220;Decentralizing Worldwide Poverty Alleviation.&#8221; The charity isn&#8217;t up and running yet\u00a0\u2014 there&#8217;s a <a href=\"https:\/\/bitcoinexchangeguide.com\/binance-creates-blockchain-charity-foundation-with-maltese-presidents-trust\/\">Memorandum of Understanding<\/a> with Malta\u00a0\u2014 but it plans a <a href=\"https:\/\/medium.com\/binanceexchange\/binance-charity-foundation-architecture-75c95d063dc9\">complicated donation architecture<\/a> in which &#8220;We envision a 3 or 4 layer donation tracking system&#8221;. The <a href=\"https:\/\/twitter.com\/weepingguitars\/status\/1049228390694375424\">first response<\/a> (<a href=\"https:\/\/web.archive.org\/web\/20181010200822\/https:\/twitter.com\/weepingguitars\/status\/1049228390694375424\">archive<\/a>) on Twitter: &#8220;I don&#8217;t like this idea. Your revenues should go to rewarding your team and the improvement of the platform. Not go to welfare&#8221;. CZ suggested it was <a href=\"https:\/\/twitter.com\/cz_binance\/status\/1049230141681938432\">his money, after all.<\/a><\/p>\n<p>EOS ran an ICO token offering that was so egregious I used it as <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/icos-magic-beans-and-bubble-machines\/\">a perfect example of the form<\/a> in <a href=\"https:\/\/davidgerard.co.uk\/blockchain\/table-of-contents\/\">chapter 9<\/a> of <em><a href=\"https:\/\/davidgerard.co.uk\/blockchain\/book\/\">Attack of the 50 Foot Blockchain.<\/a><\/em> You&#8217;ll be <em>shocked<\/em> to hear that there&#8217;s <a href=\"https:\/\/www.trustnodes.com\/2018\/09\/29\/rampant-collusion-in-eos-exposed-by-huobi-leak\">rampant collusion and corruption<\/a> amongst the controlling nodes of their blockchain.
